PAYG Tesco problem-Faulty phone

i was hoping someone could help me.
At the end of september i purchased a samsung m150 on tesco mobile. It was for my daughter as a xmas present.I bought it early as i was/am struggling financially.

The phone has now developed a fault where the screen is coming away from the phone.It can be pressed down and lasts for around 3/4 days before it pops up again.
I'm so disappointed with this phone.
it says on the box 'style with multimedia' yet it only has a VGA camera, has no data cable with it and shockingly to me only has a 20mb memory with no expendable memory.
My daughter who is eleven is struggling with it and says its not as a good as what she had previously a cheap one on '3'.

I've rung the helpline number for tesco only to find i have to book the phone in for repair which could take as along as 10 working days.

Can I not get a refund?
i still have my receipt.

please help

  • Unfortunately you are only entitiled to repair under warranty and if you are going down the SOGA route, after you have accepted the product (usually taken as 28 days after purchase with most retailers) it is the retailer who decides on the remedy (repair/replace/full or partial refund).

    It's a shame that you and your daughter are disappointed with the handset but it is a multimedia handset (it has a camera, takes video, has a radio and internet access) and it does seem like a good all round, if somewhat basic, phone. Regarding the USB cable, most low cost handsets do not come with these included in the box but you can buy them online fairly cheaply or you could opt for a bluetooth adapter so that you can transfer data from any bluetooth enabled handset to your pc/laptop.

    There are two separate issues here.

    1. You give the impression you do not like the phone. You have no redress at all.
    2. Under the SOGA the retailer has to act reasonably in terms of any repair offered. Is 10 days a reasonable period to repair a phone? I guess if it were your only phone you could argue that Tesco should loan you a handset.
    As an aside I have always found Tesco to be reasonable and fair. Each store has a customer service desk with well trained staff. I would go to your local store with faulty handset and proof of purchase.
