estate agent drivng me mad

hi everyone
i am trying to buy a house!!
called estate agent to book viewing she surgested we see another property at the same time as it was over the road hadnt noticed it as it was a semi and we were trying to get a detached. she informed me that it was up for 195 but they would except 185. as it turns out the house i called to view was not suitable but fell in love with the semi. view sat 16th we were very enthuiastic during the viewing. agent said he would call monday about 10. lovely
1 oclock on monday i called them said i had viewed on sat and wanted to put in offer..
5 oclock they call back to take offer from me. told them we had not yet recieved mortgage aip but expecteing to hear any day... put in low offer of 170 .
went in so low as property requires double glazing, rewiring , plumbng total redecoration new kit new bathroom.. last property sold next door last year for 155 1 less bedroom and generally smaller plot....
had first offer refused tried to hold my nerve and also wait until mortgage aip arrived . ea said he would call on fri or monday to catch up..

monday i called agent and asked for a 2nd viewing . really wanted to see place again and wanted to keep communicaton open... was told diary busy and they would call me back.
tuesday i called them back to ask if i could view again as noone had got back to me!!! told they were very busy and thurs was the earliest i could view could not accomodate times suitable for my partner and i to go so had to except a time only i can view again.

does this sound crazy to anyone????? today i noticed t has been put up with another agent no surprises there... today at 3 i called to ask if i could up my offer as recieved mortgage aip . still waiting for someone to get back to me!!!!!
do i have to stay with this agent as i viewed property with them or can i contact the new agent as they might be more interested.
oh yes and the sellers have already had a sale fall through and apparently are very keen to go as they have found a place they want.
am also selling 1 month into sale and the person buying mine is in no chain..practically cash buyer!!!

    I suspect if you buy they would have to pay the 2 estate agents fees as the first one introduced you and the second one would have to deal with you from now on. They might try to get that money back from you in the sale by expecting more I guess.
  • The old agents have been messing you around because they probably knew they were not going to be handling this property any longer. You don't even need to go through the new agents, you could phone the vendors and ask them for a second viewing, they may be amenable and that would mean that you as buyers were not introduced by them and they would save the agent's commission on the sale. It all depends upon whether it's a sole representation or the vendors have the property with both sets of agents.

It looks to me rather strange that the vendor took it off the first agent while in the middle of a negotiation with you, but I suspect they were feeling that the first agent was using your offer to play games ie, they felt that the agent was putting up a fake offer which was too low to be taken into consideration.

    Did you meet the vendor, or is this a probate sale?

    Unfortunately you are now tainted by association with the first agent, certainly if you go to the new agent. Hopefully one of the EA posters will be along soon to advise.

    ETA, I think BitterAndTwisted may have something in approaching the vendors direct - but it all gets very murky.

    Officially the first agent 'introduced you' so if you end up purchasing the property the Vendor will have to pay their fee.

    You could go to the new agent and let the Vendor sort it out with the agent themselves.

    I think that if you get nowhere with agent one then I would approach the Vendor directly to see what is going on.

    You just want to buy the property....let the Vendor sort out the fees!

    Vendor only......I would be inclined to let the Vendor worry about who gets the fee.

    well the agent didnt get back to me today find out what i have upped my offer to...have 2nd viewing booked for tom with the original agent so will have a few stern words for him...
    no i didnt meet the vendor she was out when viewing took place.
    i dont know if they are going to have multiple agents at the moment both are advertising property....

    I wouldn't have any words with the agent, it isn't your place to as you did not appoint them and you are not paying their wages. I would pop a note through the vendors door asking them to contact you directly and inform them of the shoddy service.

    to be fair ea called this morning to say i had a viewing booked and discuss upping offer with ea there.
    so did the 2nd viewng and asked if i could up upper explaining that waited till i got my aip and this was the first appointment i could get to view again. otherwise would have offered sooner..
    all well and good ....only ea doesnt take the offers the girl in the office does knows she is very busy but will get back to me by the end of the day!!!!
  • In my opinion, an offer of £170,000 for a property on the market at £195,000 which requires extensive modernisation is a realistic offer so don't be pressured into upping your offer. People always think of increasing their offers in thousands of ££. Why not edge up by £500 and see how it goes?

    Also, if you don't mind me saying, your posts convey the impression that you're buying this house with your heart and not your head. You wanted a detached and you're settling for a semi. You ready for shared walls? Who will your neighbours be? Each time I've bought a property, I've viewed it at least three times and I take my time looking around the property itself and the area. I wish you well.
