    Just do what is right and pay the thing off. The £544 has built up because you failed to act like a responsible adult.

    Contact them and arrange to pay the £544 back in installments.

    Thanks for your 'help' Linux. I suppose you have never made a mistake? I guess you think it is fair to pay over DOUBLE what I owe then do you? I would call you a muppet but I am not allowed to...:rotfl:

    If you'd delbt with the debt in the first place you wouldn't have run up additional charges.

    Yes, I have made mistakes and I've delbt with those mistakes. I didn't try running away from them by continually moving house hoping they wouldn't catch up with me?

    Its statute barred 6 years after the last contact ie. from the last letter that you've received for Lowells/Red so 5 years xx months.

    So your likely options are:
    Contact them to try and discuss a repayment plan
    Await a CCJ

    I'm well on the way to having 20k of credit card debt off across 3 cards written offs. How do you like those apples you smug tw.t.

    Those are the sort of posts I'll gladly applaud rather than inflamatory ones from either side of the opposing camp on the pay it/don't pay it circular debate we seem to get all too much of these days.

  • MUFC, £20k written off? That's incredible! Well done, you must be soooo proud.

    With that mentality, you're probably a tax blagging, work-shy sofa klingon. Let me know your address by PM and I'll send you the shirt off my back. I'm already a 40% tax payer, giving you little more won't really make a big difference.

    However I have been getting letters asking for payment of a debt for £544 to Capital One for the last couple of years from Lowells and now Red.

    Red and Lowells are the same company, just using different "trading" names.

    It is not mentioned as a Capital One Credit Card on Equifax, but as a Lowell Portfolio Credit Card.

    Don't know why it is now Lowell instead of Capital One. Is this normal if the debt has been sold on?

    Yes. Perfectly normal if the debt has been sold.
    Can anyone tell me when a debt is statute barred? Is it from the time it shows on my credit file as going into default which is March 2005, or is it from when I last paid which is never I guess? Or would it be when I last used the credit card for payment?

    If you have never made payment or acknowledgement, then the 6 years runs from the last "cause of action".

    That is usually considered to be the first missed contractual/monthly payment.

    The default date is irrelevant for this purpose.

    Also it seems Lowell have been searching my credit file, obviously without my consent, is this legal?

    Yes.
    It shows on my file as being searched by a debt collection agency which doesn't look good. I hope to apply for a morgage in the next 2 years as I now have a decent wage and I am worried all this will affect my chances.

    Unrecorded search. Should not show to a mortgage company. The default is the bad thing.
    Would it be better to just pay the debt? Although out of principle I would prefer not to do that as I think it is preposterous that an original debt of £200 is now £544!!!

    If I do let it go statute barred will it just drop off my credit file or do I have to apply to have it removed? And once itis gone will my credit rating be repaired by much?

    Yes. It will drop off 6 years from the default date.

    Unless they get the threatened CCJ that is.
