need advice about my rights regarding paying a window fitter

hello all,

I have recently had my windows fitted by a trader, he is a bit of a lad and has a potty mouth!

he quoted me £4250 for the job and i agreeded to go ahead with it. We never wrote down what that included.... my fault for being too trusting i know.

However....

First thing - once all the windows were in he told me he the price didn't include the trimming, i assumed it did and this being my first time having windows fitted said that fine and ordered them myself! possible stupid of me. especially as i had a conversation with him saying he would do the trimmings!

second - he wants payment remaining £250 balance payed before i recive a fensa certificate...... do i pay him?

thirdly - he wants paying tomorrow and has more of the job to finish (replacing a cracked pain that he cracked whilst fitting (he's paying for that)

my worry's are:

1. he wont provide a fensa cert
2. he wont replace the window without having the cheque in his had so he can leave fully paid
3. if i dont pay him he will get iraite and i may feel threatend

can anyone tell me my rights?

    Is he FENSA registered?, if not if shouldn't be fitting your windows.
    Get on to Trading standards, they will help.
    OH is a builder and says that trimming should be included in the price. He had never known it to be extra.

    Tell him that you'll pay the remainder once the job has been finished and the certificate is in your hands - not before. If he's genuine then he'll do it, if not then you dont want to be giving him any more money anyway.

    get in touch with fensa and check that he's registered. they come down hard on people using their name who aren't supposed to.

    and by the way, you dont have to be fensa registered to install windows

    i would also wait until he's replaced cracked pane as well before you part with any cash , the job should be completed to your satisfaction
  • okay what i have done it contacted fensa, they dont have him on their system! these means he is offering a product he cant provide and i will never see a fensa cert or he is registered under another name/business (hopefully).

    he is coming today to finish the window, i've also asked him to foam one of the windows and clean up all the glass which is scattered around the building. i've said i will pay him once he has done these.

    I haven't mentioned the fensa thing as i think if he thinks there is any chance he isn't getting paid he'll not finish the jobs that he is supposed to. Then if i dont get some form of confirmation the he is fensa and a cert is on its way i will not pay him.

    If he does come up with the goods i will be reducing the cost of the trimming (materials only) from final payment.

    I think i just need to have confidence in the fact that im the one paying him and he is working for me. If i did a crap job in my workplace there would be reprecussions.

  • hey chaps,

    So.... He turned up i kindly asked him if he could do the following.

    Clean up the glass from around the building,
    replace glass,
    put some extra foam in where he hadn't previously put some,

    and before i had even mentioned fensa certificates he said forget it and walked off! completely bazzar! and even more strange he left the replacement glass on our front door!

    so i guess he resolved any conflict that could have arose by himself! however this does leave me without a fensa certificate.

    Any suggestions?

  • contact the building control at local council tell them whats happened and pay for one of them to check the instalation and issue a compliance certificate

    So he wasn't prepared to do a couple of hours work to get his £250? That indicates to me that he has already made enough on this job not to be bothered.
    I assume you'll not be recommending him...
    No free lunch, and no free laptop ;)

    Wont help resolve the FENSA certificate issue but you can make sure you tell everyone you know about what happened and make sure he doesn't get any more work in your area.
