Wrong Colour of car on PCN

Hi there,

I received a PCN tonight @ 20:53 but the colour of car is incorrect, they have put white instead of yellow. The Violation is parking in a taxi rank (code 45) Didn't realise it was a taxi rank as a big van was parked infront of me and another car in front of him which obscured the faded markings on floor until i came back to car and the van had gone and i had a ticket slapped on my screen!! :mad:

Just wondering if the incorrect colour will invalidate ticket? What should I do now as if i pay within 14 days it is £35 instead of £70 and then put an appeal in! I dont want to end up getting a CCJ or court action etc. if the appeal takes over 14 days or even worse 28 days!

Any advice would be much appreciated!

    If the markings are unclear then I wonder if that's the best route to take. Either way may be worth going taking some pics of the area where you parked and posting them here.
  • Cheers for reply! Unfortunately i do not have any decent pictures of the Taxi rank and I live an hour away from where the ticket was given so i won't be able to take daytime photos.

    Here is a scan of the ticket and a dark pic of taxi rank where van was!

    I don't think colour matters, as different light source make various colours very hard to make out correctly, and it doesn't make much difference if the registration, make/model and date etc are correct.

    As mentioned the better bet is if the rpad markings etc are not clearly set out.

    P.S.
    The pics aren't showing, you probably need to upload them (with the registration/personal details blacked out for privacy - you can use paint or irfanview to do that easily), somewhere like imageshack should allow an upload easily enough :)

    it could make a difference.

    people clone cars by finding a similar legal car and making up number plates that are the same details to use on the stolen one.

    who knows, you might be able to get off on a technicality, I dont know how accurate the information has to be. im thinking if say they got the time wrong, maybe didnt set their watch backwards an hour, and used the wrong time on a ticket, that should be pretty much a case of invalidating it.....so why not when the colour of the car is different - its the law after all, and is pretty strict and black and white in nature (pardon the pun).
  • Colour of car is not, unfortunately, a major point. Its worth a brief mention along with the important points to possibly show that the ceo is not accurately reporting things. Badly faded and painted lines and signs are always a good bet when responding to a pcn, Host the pics on tinypic and put the url on hete leaving off the http:// bit. Remove personal data and leave dates.

    Were there any signs other than the road markings indicating the area was a Taxi rank?
  • I didnt see any and thought that on the opposite side was the same as where i parked. That was a pay and display but don't need to pay after 6pm and i arrived at 7.30pm so didn't pay for a ticket.

    Really it looks as tho i will have to pay.

    Can i pay for ticket and put in an appeal too as i don't want the appeal going over 14 days and i will have to pay the full price of £70. The £35 is bad enough!! :-0

    As long as you make an informal representation within the 14 days, the council should extend the 14 day period until they have considered your appeal
