I'm trying to leave my house but agency is making it difficult.. PLEASE ADVICE ME

    But if this house is damaging my health, and my girlfriend health, and it has been reported to a GP (backdated even before signing the contract). Could I make this house unfit to live? if so how?

    Also my agent has now planned to get his builder to restore the whole house that including kitchen, bathroom and knocking walls.
    I do not want live in building site! and he said that I might end up without a toilet for 8 days (if he says 8 days knowing him well mean at least 15 days) and on some stage the kitchen would be unusable and the house will be covered in dust.

    He therefore has proposed me to move out and pay £3000 to terminate my tenancy agreement . I do not have those money Should I take my chances in the court?
    what would the outcome will be after that? is my future at risk?

    I'm sorry for all of those questions. As you can guess English is not my first language and if law terms are quite difficult for most of you try imaging what they look like for me.
    I'm devastated.
  • Consider following your solicitor's advice!

    For the proposed building-works and the disruption consider contacting your local authority's private lettings department. Also Environmental Health.
  • The £3000 offer seems pretty decent to be honest given you have a £1200/month liability until September. It's not much worse than the 2 months notice you would probably be required to give even if you did have a break clause. See if you can get a loan if you don't have the money, and make sure you get any agreement in writing.

    If the house is really in such a bad state as to be unlivable then you could in theory move out without penalty, but we are talking ceiling caving in scenarios here. And don't even think about faking that sort of damage as you will end up in jail if you do so.
  • I'm not faking anything! I was looking for a loophole to leave the property. I do have a have a nasal infection that I am treating as we speak. I do sneeze quite often and my eyes randomly tears. I had sinthoms like spitting blood (I had to take 2 days off because of that). And because of the infection I suffer from coming and going fever. I'm a extremely healthy living person. I do not smoke (I hate it). Don't drink, (at less then 2 unit a month). And eat well.
    So from that point I'm legal.
    My girlfriend has the same health conditions and same lifestyle.

    3000 pounds I would pay it no problems if I had it!!! but I can get credit has I have tried to buy motorbike in Feb 2009 and I have been refused. I also forgot to mansion that I got made redundant in May 2009 and I applied for JSA in august and never applying for housing or council tax benefit just because I didn't want to break the law. (subletting rooms and get government money). So I have survived with my own saving and my girlfriend job. I should start working again in February with the same firm at £150 a day (same figure as before become redundant ). So I should be ok after that.
    I feel ashamed of being on JSA as I never claim any benefit in 34 years of my life, I only done that to get some free training and a CSCS card (belive or not). Nothing else

    You haven't paid December and January's rent (presumably Febs will also go unpaid) but you applied for credit for a motorbike?

    Go and speak to Shelter - they may have a drop-in office local to you. or book an appointment with Citizens advice. Shelter has a good section on how to get repairs done.

    Shelter recommend that tenants do not withold their rent. A landlord is entitled to take tenants to court for the rent arrears and if the judge finds in favour of them, the tenant does end up with a CCJ which will ruin their credit rating for years.

    For health related issues caused by the property, speak to the local council environmental health department.

    For benefit entitlements speak to Citizens Advice or look at the Entitled To website.

    By the way, is the property in England/Wales? Did you pay a deposit? What is the date of the last contract? if in England/Wales, did you receive notification that your deposit was protected in a tenancy deposit scheme?

    If you lived with your girlfriend, and/or if you earned income from the other tenants, chances are that you wouldn't be eligible for LHA anyhow.

    No that was in 2009! I was well up on my legs at that time.

    It's London so yes England. I did pay for a deposit in my previous occupancy contract. In the actual contract states that there is £1300 deposit (but I never received any notifications and I do not have any receipts). The date of my last contract? before this one? I don't know exactly as it was expired for more then 2 years as my ex flatmate where refusing to sign one to protest to the bad managing of the property. ( I had would have done the same now).
