Hey guys done a quick search in google about memorybits and this thread came up.Sorry mods if I'm bumping an old thread but had the misfortune of dealing with these today.I recently bought a PSP and I was looking on their website for memory cards for it.I had previously used these before and it worked out fine not today though unfortunately.
Right everything was going fine till i clicked on checkout and before when I used them I got charged 4 pound overseas charge which was grand but there's only a FREE UK SHIPPING option at the checkout so I couldn't buy it there and then since I'm from Ireland and it's not classed as the UK.So i thought there would problems with postage etc so to put my mind at ease i decided to use there "Live Chat Option" really wish I hadnt.
First there was "Kasia" and I told her my query 3 times then first she wanted me to phone an english number about it.I asked her whats the point of Having this feature on the site if your gonna ask me to ring them up then she said something about changing address on my account and I replied with so you want me to change my address to a UK one so i can get it delivered how is that supposed to help me?She logged off then not great customer service if you ask me.(At no point now may i add did i get angry etc etc)
Then decided to try it again got through to "Kelsey".Explained my query again got told it's free shipping everywhere tried to explain that ireland isn't classed as the uk and that was the only option in the checkout. She replied with"But it says it all over the site(free worldwide shipping)" to which I added the one place it's not at is the checkout and isn't that the most important place to have it.Plus I said wouldn't be easy to change the option to worldwide shipping instead of just having UK Got told my query was answered 3 times and she logged off.
Well I can tell you wont be using that site anymore stay well clear people if you ask me.I'm going to go to my local gamestore and buy one there sure it be a bit more expensive but at least I wont have any worries that it mightn't get it delivered. So well done Kasia and Kelsey keep up the great work and there will be noone using your site.

you: Please read the following to help you understand.Returns and refunds June 30th, 2008 • Related • Filed Under • Bookmark and Share Related: I’ve been sent stuff I never ordered! Protection against card fraud for mail order goods and services Distance selling: your right to cancel Filed under: Refunding Delivery Charges Getting your money back Under the distance selling regulations, you are quite within your rights to change your mind at any time within the first seven days, return the goods and get a full refund. This means without financial penalty of any kind – such as a cancellation charge or a ‘restocking’ fee. The supplier must also refund any delivery charges paid by you, and any other costs related to the contract. Refunds must be made within 30 days from cancellation, whether or not the goods have been sent back. Any related credit agreements will also cease to exist. You may be required to pay to return the goods, but you must have been informed of this as part of the pre-contractual information. if the goods are faulty, then under Sale of Goods, the supplier will always bear the cost of returning them. Returning the goods Unless you are required to return the goods, and you were informed of this, your only obligations are to make the goods available for collection and to take reasonable care of them while they are in your possession. This is called a duty of care. Where the supplier has made provision to collect the goods, this duty of care expires after 21 days, but where you have agreed to return the goods, your duty of care continues until you do this and could be for as long as 6 months. Packaging Under a distance selling contract, a supplier cannot make refunds subject to the goods being returned unopened in their original packaging. One of the principles of the distance selling regulations is to give you a chance to examine the goods at home, not having had a chance to do so in the shop. It would be impossible for you to do this without opening the packaging and trying the product out. Having said this, you will still be under a duty to take reasonable care of the goods while in your possession, and may be subject to certain instructions such as not to wear shoes outdoors, or remove hygiene seals. But you can never be penalised simply because you did not return the goods in their original packaging. Know all the facts before you decide!
Kelsey: Unfrotunatly I am unable to put this through to be refunded as our terms and condtions state that we will take £1.99
Kelsey: I said please ignore my last message. Unfortunatly I am unable to put this through for a refund.
you: Can I speak to someone with more Authority please?
Kelsey: Unfortunatly you cannot speak to anyone via live chat. The manager is not avaliable to sperak to via telpehone at the moment, I can psss a message on for you and hopefully she can give you a call back.
you: Please ask her to call me on ********** or **********.
Kelsey: Ok I will pass the message on as soon as she is avaliable to speak to and I hope you receive a call back soon
you: This is now a matter of principle with me. Its not about the £1.99 . Its about your company failing to carry out its legal obligations. What e-mail address shall I use to take this matter further?
Kelsey: sales@memorybits. I will pass the message on for you.
you: Thank you. I must say I am annoyed, disapointed and suprised by your company and shall not be ordering from you again. You have lost a customer for the sake of £1.99. I shall pursue this matter further. Thanks for your patience. Goodbye.
Kelsey: I am very sorry to hear and sorry i could not be more help, but unfortunatly I am unable to authortise this refund. Goodbye.
Hope this info about this company is of some help to someone else

PS I'm now trying to find out if they are covered by DSRs as they are trading in Jersey0
-
They won't be covered by the EU DSRs as Jersey is not in the EU. The Jersey Government has introduced their own version, however:
http://www.jerseylaw.je/Law/display.aspx?url=lawsinforce\htm\LawFiles\2007/L-37-2007.htm
This is a different law to that of the UK, so the details of the regulations may be different to those of the UK (I haven't checked). You'll also need to take any legal action in the Jersey courts. It's very similar to the situation for play.com, which is also based in Jersey.

This thread has suddenly become of interest to me as I had previously ordered from R4i and memory bits on many previous occasions and always received my order within 3 days max.
For obvious reasons R4i has recently dissolved, I have recently ordered from memory bits but received nothing at all .... Weird ?
I have tried emailing them and no response at all, also the live chat facility appears to be permanently offline now, it does make you wonder if this company has collapsed as well, I do hope not as I like these sort of companies with their gadgets etc.
