    As I indicated before, I wasn't aware of the practice of a local council looking at previous accommodation and why they are no longer in it.

    The OP says that the landlord asked him to leave the property but didn't specify if he was served a Notice to Quit - i.e. is he able to demonstrate the landlord served notice or does it look like he left of his own volition?.

    If he'd have gone to the local council at that point, they probably would have told him to apply for LHA, ignore the notice and remain in the property until the landlord had applied to the court for a possession order. They cant give this advice for his mother's property - he is a guest in her home and has no rights to stay there. She has every right to turf him out and change the locks if he stays longer than the notice period.

    Anyway, hopefully the OP can come back on Monday with an update on how the council is progressing his homelessness application and what advice Shelter has given him.

    But surely it would have been expected that in the 3 months without work the OP could have got LHA sorted out and thus never needed to throw himself on his mother's mercy. If he had been able to demonstrate to his LL that the rent issue was being dealt with then presumably he wouldn't have had to leave.

    The parents are making them homeless.

    The parents need to put in writing that OP can no longer occupy the property and the leaving date is XXX. Parents phone number needs to be included on this letter. Then the assessor will then make contact with MUm to check that the OP is telling the truth.

    At this point, the LA will probably offer some support in finding rented property in the private sector with a LL that will accept LHA.
    I quite agree with lynzpower.

    I think when OP applied for the initial homeless claim, he may not have been entitled to be on social housing list as a homeless person simply because regardless of OP being out of work or not, he didn’t/couldn’t pay his rent which is considered as making himself homeless on his own accord. It would have been different if the landlord said ‘we want to sell the place/move back in ourselves, now get out’ then he would have been made homeless legitimately. However, the situation now is that he has been living with his mum and mum wants out ;)

    So there is a chance but it all depends on different factors:-

    1) Is your mum’s house in the same council as the place you were renting before?
    2) If in a different council, possibly, your particular council may say that you must have lived in the area for e.g. 6 months before you could apply for housing

    Also I wanted to further illustrate about how different councils operate. When I applied as homeless, my council told me that I can only be put on a register for the council housing and not for housing associations. I could only re-apply to be housed by a housing association after I’ve got my council flat so I was not possible to go direct on the housing association list. However, my friend who lives in Kent was housed by a housing association right from the beginning!

    So get as much local information as possible from CAB, shelter etc at this stage and tell your mum to keep her happy that you are on the case.

    Has your JSA application come through yet? Because these B&B or private landlord who lets out to council charges bomb!

    Your wife is pregnant and I’m sure that’s the reason why she is extra emotional when it comes to your mum. Hormonal ups and downs are tough one to cope with. This is a bleak time for you but don’t lose your hope. Come here to air your concerns, some of us have gone through what you are experiencing and we’ll support you if we can.
