    Why do you not believe that. In the declaration at the end, it states you will be called back within 48 hrs. If you are not available to take the call to answer the full questions, then they can assume you no longer wish to pursue the claim. ( and do not have an answering machine/ wrong callback number ) As I said, the Contact centre computer system will hold all the information and the outcome of all attempted callbacks.

    Because the law very clearly states what is required for a claim to be considered a claim. And what is required for a claim to be defective. Nowhere in the law does it say failure to answer a telephone call results in a defective claim. Nowhere. At all.

    The law requires you to complete a recognised claim form and supply all requested evidence within thirty days of your first notification of intent to claim. Not answer a bloody phone call. (not swearing at you, just the JCP's insistence on ignoring the law to satisfy their own ends)

    EDIT: Oh, and I forgot - why would backdating even be necessary in light of the thirty day thing above?

    I've dealt with this soo many times. Scenario:
    Cstr completes online form. Is given a reference number. Advised will receive callback for complete gather. speaking from experience as a new claims processor - cstr phones e.g 6 weeks later - no benefit received. Notes on system show either wrong callback number given, no answer after 3 calls (we stop calling then). What more can we do? We do not have any information on cstrs circumstance and therefore cannot make a decision on entitlememt. As no information is gathered by phone then the Benefit delivery centre is oblivious that the cstr actually wants to claim. If there is proof that we didn't call the customer back when we should have - then backdating will be awarded.

    Ah, okay, so you're talking about a completely different scenario. cool :)

    would it be easier to print an application form and post it off?
    We'd really like the quickest way to do this! And after visiting the job centre they say you cant make appointments and theyre always too busy. And phone line is also always busy. And online form, never get a call back.

    Why is this so difficult :(

    Go to the job centre and ask for a JSA1 and an NJI, if they refuse either, ask them to call a decision maker for advice.
