Advice CTB/HB

Hi

Can anyone tell me how my mums benefits would be affected if I were to move into her home. She lives in a housing association property and is on Income Support. The rent would be £270 per month and the CT approx £140.

I am 26 and earn £25000 p.a. Would I be liable to cover all the rent and 75% of the council tax? Would the rent only be halfthe figure if they accepted me as a joint tenant on the tenancy agreement.

Sorry for my lack of understanding I am inexperience with these issues.

Thanks in advance for any advice.

What happened to you getting your own place because of the mess you have made living with your brother while having your mail delivered to your mums?

  • Hi Sunnyone

I am looking at other options that would be more sustainable due to my current circumstances. I know a couple of replies point to the fact that moving back in with mum would look suspicious but to get my own place I would need approx £1200 to get started and I just cant afford thais at the moment.

If it would be cheaper to move back to mums then this is the best option for me. I know I earn a reasonable salary but I have a lot of debt.

Unless your a joint tenant/owner then you have no personal council tax liability and its your mother who would be responsible for a full council tax charge less any CTB that is payable.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

She would lose 47.75 HB and £6.95 CTB. She may also lose some income support depending on which premiums she receives.
  • Thanks Macro

Are those weekly figures I take it based on me just being there as opposed to being joint tenant?

In which case the monthly Rent and CT payable would be?

What makes you think that the HA will allow you to be a joint tenant?

Particularly given that he hasn't lived there for the past couple of years.

OP, the deductions mentioned are weekly. Why would you want to be joint tenant?
  • If they agree that I wasn't staying with my mum and conclude that these were genuine errors, why would they not accept me as a joint tenant?
  • what i am basically asking is if i was a joint tenant would i be liable for half the rent only (£135) as opposed to £270 less my mums ctb

The tenancy and the benefits are two totally seperate issues. Social housing is not let out willy nilly - there is a dire shortage of housing stock and the HA would probably not be looking to make you joint tenant with your mother, especially given that it's not been your home long-term. Your HA website may be able to confirm one way or another.
