Can i claim?

Hi all

Just a quick question i would like your views on please.

I took out 3 loans about 4/5 years ago. One was with HSBC, one with Nationwide and one with Egg. I defaulted on each of these as i took out a DMP and the debts were passed on to DCA's.

My question therefore is: can i reclaim any PPI that i may have been mis-sold? And do i go to HSBC et al or the DCA's? I have no idea of a/c numbers, t&c's etc. so i guess i'm not in the strongest position!!

Any help greatly appreciated.

Thanks.

    Hello there

Yes you can still reclaim on these.

You do this through HSBC complaints dept if they have a separate department for these, of just their standard address, where should still hold all your data going back as 5/6 years, even if they are passed on to DCA.

However if successful, they may refund towards the debt, and if anything remaining it should be refunded back to you, but all banks vary from one to another.

If you've no paperwork it may be a good idea to request a Subject Access Request (SAR), they should as stated above still hold info on your accounts, there is a charge of £10 postal order or cheque payment, and they have 40 days to send all info they still hold on you.
If they are unable to send it, then they will return your payment along with a letter to explain, but they should hold your details on your accounts anyway, despite them now being in a DCA.
    Template here of SAR:

Post by recorded delivery as well, this is your proof of posting.

In regards of reclaiming, when your ready, this link here is the guidelines, with template letters, a checklist of mis selling reasons and so on, they have 8 weeks in full to respond, again use recorded delivery.

    Hi there and welcome.

Then first of all you actually write to Barclays bank who gave you the loan.;)

They have 8 weeks in full to respond, and post by recorded delivery for your proof of posting.

    Hi Darren

I do believe that some banks have stopped selling it, and if anyone requires it from the bank they now request it..I think.
But if you have been paying for it and have reasons to reclaim, then go for it.;)

  • can you still put in a claim if you have claimed on the ins? I am sure you can't ?
I had loans from lloyds tsb had a claim which paid a few months while recovering from major surgery, when I went back to work I was made redundant & couldn't claim again because of time scale again I will have to get the files out.
