 There is no question that my brother would rather we sorted something out between us. My mum has done nothing wrong but the impression i have be givern by a couple of posters is that its not as simple as that and that the council would need proof which I dont think I have due the the informal arrangement. Should my brother and I draw up a tenancy agreement and is this just creating a bigger mess.

            Bearing in mind that it is your brother's mother as well that is in potential trouble why won't he just admit to the error and you pay the 25% extra council tax?
 If it was my mother i would do that even if it wasn't true rather than have her prosecuted for fraud.0

            in my experience 90% of the time they would still investigate. fraud officers see conspiracies everywhere!0
