  • merlin that is for all 4 of us, no i dont work, sh1305 we dont claim DLA, and DX it says £240 per week but it says (income related)ESA .

    Are you on a joint claim, it doesn't sound like you are. You also need to tell tax credits that they are paying you wrong and that you are now on esa, they should up your payments. They did with us. Ring up esa and add your self to the claim they should backdate.

    The Applicable amount for a couple is £100.95 on ESA(IR) but IIB is taken fully into account on ESA(IR) so only the personal allowance ESA(C) is payable.

    Are you getting Housing Benefit? If so then you are on a lot more than you are trying to claim you are.

    your ESA will increase, if you pass your medical - dependant on how you are assessed. AS merlin68 said you may be entitled to more tax credits but this is dependant on how much other income you have had this year - have you or your partner worked since last april?

    I assume you're getting child benefit, and council tax benefit? Do you rent or have a mortgage? If you rent you should be getting housing benefit, if you have a mortgage then make sure you have completed a mortgage help form called an MI12 form, if you qualify you would be eligible for this from 13 weeks into your claim.
  • we are not entitled to any more tax credits, i contacted them when my hubby lost his job, they said contact them when we knew what benefits we were getting, when i gave them the info and hubbys earnings until end of November, they took £10 a week off me, apparently its something to do with the time of year(being nearly April), i am totally stumped. its a claim for both of us, because my hubby gets IIB=57.44, we are entitled to 64.30 ESA, instead of £100.95.the CAB phoned tax credits but they say there is nothing we can do until April..

    £121.74 instead of £100.95 - damn that's harsh - I cant believe they did that to you.
  • i know nasa, i am getting £26.72 for 2 teenagers as well....my god i am truly thankful, and i am sure my hubby is grateful, especially considering all the taxes he has paid....

    My point is that you are getting more money than you would otherwise be entitled to if you were just getting ESA(IR). Seems a strange thing to whinge about.
  • i know that nasa, but i didnt ask for any of this. i was wondering if people could help, not criticise. If our needs allowance is more than we are recieving, then there is something wrong somewhere..believe me we dont want to live like this but until hubby has his op we cant change anything..

    Your income is approx £180 (if £31 child benefit is added in) a week and you say you have applied for housing cost help. It does seem a reasonable amount for 4 of you to live on if housing costs are paid.

    are you not able to work?
