Faulty Mobile from CPW - My Rights

This is (unfortunately) quite normal with their "repair service". I've had several occasions to take phones back and had many arguments in shops and with head office. Some shops/managers are better than others, but more often than not you end up with faults you didn't have to start with, weeks without a phone and (finally) a replacement reconditioned one which is rarely as good as the original (and which also often has worse faults than you started with).
Regardless of the fact it was "free" as part of an airtime package if the phone was faulty from day one it is not of merchantable quality under the Consumer Credit Act and therefore you should be entitled to a (new, not refurbished) replacement. Unfortuantley you are dealing with a company which prefers to create its own laws to suit itself, so you may need to consider putting things in writing to establish early on that the phone was faulty from the start and asking for an immediate replacement. Trading Standards is not an organisation I rely on, but there's no harm in running it by them. The further you go down the slippery path with CPW "repairs" the harder it might be to demand a new phone.0 -
Hi Mitzey,Told him that I was not happy that I have had to return for a second time as the phone is still doing exactly the same (losing all charge after a few hrs)
This problem was being discussed on the Voda forum, seems there was a bad batch of them by the looks of it ........
