made redundant and need help 2

Further to your letter of 13th January 2010, and our subsequent exchange of e-mails, I am writing to confirm details and arrangements for the Appeal meeting that you have requested in relation to your proposed dismissal on the grounds of Redundancy from *** Ltd.

I would like to remind you that you are still in the employment of *** Ltd, and therefore, are required to make yourself available for meetings associated with that employment.

I believe that the time and location that I am suggesting is a reasonable request, and takes account of your desire to meet at a 'neutral' venue. Due to so many staff being involved in the Appeal meeting and also, others being out of the office with customers, it is essential that we can get back to the office as soon as possible following the meeting, therefore, your proposed venue at Horwich, that would require an additional travelling time of some 30 minutes each way, is in the circumstances not practical.

The meeting will be held at the Copthorne Hotel, Salford Quays, on Tuesday 19th January 2010, at ****. The meeting will be held by me (Wayne), with Louise ****** in attendance to formally minute the meeting. Consistent with other formal processes within *** Ltd (eg. Disciplinary and Grievance Process) and, as detailed in your Contract of Employment (attached as requested), you have the right to be accompanied at the Appeal meeting by a work colleague of your choice. If you do intend being accompanied, I would ask that you confirm who this will be by 2pm, Monday 18th January 2010.

The person accompanying you is there as "an extra pair of eyes and ears", and to have someone to talk things through with at any adjournment.

Since our original meeting when I notified you of the intention to make you redundant, you have raised a number of further questions or concerns. I would propose that these be covered in the meeting, to ensure that they are fully and appropriately covered.

It is my desire to resolve all the questions that you have raised in a fair, timely and amicable way, and one that is consistent with any legal obligations.

If there are any specific reasons that you are unable to attend the meeting, given that the venue is a short drive closer to your home than the office, and has been arranged within your normal contracted hours, I would ask that you give me details of these reasons in writing by 2pm Monday 18th January.

Likewise, should you have any further questions or concerns regarding the meeting, please do not hesitate to call me.

    Can you not attend the meeting?
    Do you have further issues that need to be resolved?
    What do you want to do?

  • My initial question is am i entitled to delay the meeting or can i attend with an independant person . I.E friend to take notes?

    Yes you can take someone with you.

    Do you have a genuine reason for wanting to delay the meeting?
    Seems to be very short notice but as it is, as they point out, within your contracted hours and you are still an employee then I am not sure you can decline.

    Very uncomfortable reading for some reason - is there a motive to plastering all of this on the net? I'm sure you could have explained it for brevity's sake if nothing else.

    There isn't a right to bring in someone outside the company. Perhaps you can again refer to ACAS for confirmation.

    Also, I'm not sure why you're making what seems to be a huge fuss about the meeting venue.

    If the colleague you ask to accompany you has an real issue with attendance at the given time, I'd think it reasonable to rearrange as it is quite short notice given that you probably won't speak to him/her until tomorrow..
    Opinion, advice and information are different things. Don't be surprised if you receive all 3 in response. :D

  • I would like to delay the meeting to gain some advise of what possition i am now in with reguards to an unfair dissmisal claim. Further to this my reason for a neutral venue is because the director is not past inflicting violence under these circumstances.

    Somthing that i don't wish to risk experiancing.

    I would like to say that i have disclosed full details on here so that people can offer assistance to my position knowing as much information as possable.

    I hope that this would stop a continual stream of questions that would cost valuable time in my response.

    Your original post may have been done with the best intent, however it is not a good idea to post so much detail. A summary of your situation with your concerns would be much more useful in getting people to provide advice.

    First thing tomorrow phone ACAS and see if they can assist.

    Is your post being made redundant?
    Are there others in the same position?
    Are you in a Union?
    Has there been consultation?
    What grounds do you have to believe that you are being unfairly dismissed?
