Give Trading Standards a call, let them give you an outline of a letter to write to "discountbrandsforless".0

It's obvious that that isn't a "real" picture and for illustrated purposes, even if doesn't specifically say so. And in the absence of a defintion of "reworked" I'd think most people would accept it meant grade A or refurbished, certainly not "as new" as the OP might have thought. That's a pretty big assumption the OP is making.
Given that, the OP has purchased a product, not the box it came in and I don't think a tatty box for a refurbished item is enough to reject it under the SOGA. He can however use the DSRs to cancel but he will have to pay postage.0 -
No it isn't obvious, it is misleading.
If I had seen the box I was sent in a shop I wouldn't have touched it with a barge pole, if I'd have picked it up in a shop and heard the insides rattling loosely, I wouldn't have bought it. I didn't have that opportunity buying on line so I expect safe guards to be in place. B4L is a business not some individual on Ebay.
I really cannot emphasise how knackered the box looks, really really shocking.
It was only marginally cheaper than a brand new version, but the brand new version couldn't deliver to me.0 -

Who cares how cheap or not it is compared to a new item. It isn't new, its refurbished which is blatently clear. If you don't want it fine, cancel under the terms of the DSRs as has been suggested and stop whinging.
The fact that the cost was only marginally cheaper than the brand new goods is relevant and should make a substantial contribution to the OP's case or argument. If for example the goods were half the price of brand new, then your expectations would be much less than that of the brand new goods.0 -
You could've bought the same thing new from Amazon[1] for £21.51 with free delivery.
At least I, and I assume you, have heard of Amazon.
What was the delivery charge from brandnamesforless? I hope it wasn't more than £3.52.
BTW, you will notice that both Amazon and brandnamesforless are using the same photograph.
[1] apparently one is not allowed to link to Amazon, but googling Amazon BaByliss 2800U will find it easily.0 -
Maybe not to you who thinks the phrase "reworked" somehow means in an as new condition.

Thank you for your kind advice . I am going to get back in touch with them but having never been in this unfortunate position before I didn't know how to proceed hence the reason for posting on a consumer advice section on a money saving forum. You don't HAVE to read this thread if you don't want to!
I do not think Reworked means new, but I didn't think it meant a pile of tatty rubbish either. I stand by the fact that the photo on their advert is a false representation vis a vis the box I was sent and it seems others agree with me.
I did try Amazon but at the time they had sold out and the advert stated that they didn't know when or if they would be back in stock,my daughter wanted one for Christmas so I had to look elsewhere.
So for anyone who is interested, I am going to have a good read at the legislation mentioned. Contact the consumer bodies recommended. The basis of my argument will be that the photo advert was misleading. That as the price I paid was almost the price of a new one , that I expected better. And from what I have read already I think I have a good chance of getting a refund for the item and delivery costs.
Thanks to all who have offered constructive advice, it is very much appreciated.:T0
