    I know that some retailers who are have better customer services don't put returned items back on sale (eg nothing wrong the item but customer just changed their minds etc) and these companies dispose of these goods elsewhere. This was what I thought this "reworked" item would be, especially as the price was only a little lower than a brand new one and the photo showed a perfect box. So whilst the "reworked" bit might be debatable, the photo was deliberately misleading.
    I would like to put a link to the website and item here just so people can see that what the photos of these "reworked" items look like today. Would that be allowed?
    Happy to put photos of the box they sent me too.

    There sadly seems to be some disagreement between you folks as to whether the DSR or SOGA applies in this case.
    But I really feel I have been ripped off and that they shouldn't be allowed to get away with it.
  • I don't understand why Anihilator's post was offensive either or why it should be pulled....am I missing something? Blunt yes, offensive no (in my opinion anyway).

    BOTH apply, DSR apply for most cases of distance selling. SOGA applies because of the misleading photo. i.e "not as described"

    You could use both routes.
    Back by no demand whatsoever.
  • OP - how did the website describe the term "reworked?" Surely it must have given some indication that the product wouldn't really be suitable to give as a present?

    Regardless of whether it was for a present or not, the picture was misleading and the price was close enough to the price of a new one for me to think it would be a lot better than it was.

    Box, contents and attachments look like new. The box I was sent doesn't. Whether all the parts are there and work I don't know because I haven't opened it and no intention of doing so.
    The advert doesn't state that the photo is for illustration purposes only etc so it was reasonable IMO to expect something looking as good as that.

    Is have made a screen capture of those pictures but is there any other way I can save that website as it is today, in case they make any changes to their website when I complain further?
  • The website doesn't really give anything away about the term reworked. You'd think really that they'd have an explanation especially as they are using what look to be official photographs with the box. There don't seem to be any trading terms too so I'd defininely take a screen shot and give consumer direct a call tomorrow and see what they can advise.
