can i get a loan written off if i prove i was mentally ill at the time?

I have been suffering from depression for a few years now and signed a loan agreement during a really stressful time.

someone has advised me that I could try and get the loan written off if I can prove that I was mentally ill/depressed at the time.

Does anyone know anything about this?

    You can try, but you'd need cast iron medical evidence. Let us know how you get on.

    I take it that you have not spent the money, or were you mentally ill when you did that as well?

    Come to think of it, were you mentally ill when you posted?

    One of your other posts tells us that you are a discharged bankrupt. You ask "I am desperately trying to borrow some money to purchase a second hand car but due to bad credit and the fact that I have been released from bankruptcy over 2yrs ago".

    If you have been through the bankruptcy process 2 years ago, any loan taken out prior to that date has effectively been written off anyway.

    So are you seriously suggesting that some medical notes saying that Prozac was prescribed a few years back is grounds for making a lender write off a debt?

    Jeez, if that's the case we'll all have to go through a psychiatric evaluation as part of the credit scoring process in future.

    Even if a more serious mental condition had been diagnosed, what makes you think that the loan could be written off?

    To prove mental incapacity you would need to have been very ill, usually receiving inpatient care. It is very unlikely that depression alone would be sufficient to prove incapacity.

    I haven't had such a good laugh in ages reading this. Thanks - needed that to lift the depression I feel every day at having to work and pay my bills. And I speak as someone who has suffered with depression in the past, so not taking the p**s out of that aspect. It would never have occurred to me to think that was a reason to get out of a loan. Maybe if you had schizophrenia or a psychotic illness, but can't see depression will swing it.

    As somebody who has been diagnosed with Bipolar disorder and in huge amounts of debt because of it, I think that this is really cruel.

    What is cruel - giving an honest answer or people taking out credit (without any problems it seems )- the problems always starts when they have to pay it back.

    Even that would rarely be enough on its own. It is near impossible to get debts written off for mental incapacity, and if you are claiming mental incapacity there can be massive repercussions on the rest of your life. If you can't look after your financial affairs, it is likely you will be deemed unfit to look after your children also.
