Reject the car and do it ASAP before they do anything with yours.
  • Ring the garage first thing tomorrow morning (ask for the manager) and tell them that you've concluded that the only option is to reject the car they've sold you - the vehicle simply has too many faults to be considered fit for sale by them. See what the manager says.
  • Have a search around Google for advice on how to go about rejecting a car. The following is taken from WhatCar - it makes reference to needing to reject the car in writing.

If the car is not as expected, you may need to act quickly to save the situation.

    • Keep all records and paperwork, in case you need to refer to it later on.

    • If you are concerned that the car is not as advertised, you should let the seller know before you take ownership. If buying privately, it might be more difficult to negotiate an agreement. If you are not happy, avoid taking delivery of the car.

    • Although private sales aren't covered by the Sale of Goods Act, you can still pursue the seller if they have misled you by falsely describing the car.

    • If you intend to reject the car, you need to formally do so in writing as soon as possible. If you do this within two weeks, you stand a far higher chance of success and a full refund – especially if the case goes to court.

    • Send a letter to the dealer informing them of your intention.

    • If buying from a garage, it may try and negotiate a settlement with you. This may take the form of an additional discount or extra incentives. Look at these carefully and decide if they are fair compensation.

If it has been an AC lease car then the accident damage will probably have been repaired in one of their own garages and no external insurance co involved - hence HPI clear.
You havent though mentioned anything that was said by the ordertaker that was untrue or visible to you on inspection other than straightforward repairs that will be covered by the (laughable) 28 day AC warranty. Coupled to having been in a fender bender since sold and now repaired by you, I think you will have to draw up a comprehensive list of things to be fixed and allow them to fix. If they wont do that then its money back time.

Thanks everyone for all of your advice. I will have another read over the forum in the morning and take notes with me. I have also got a list of all the problems and the family mechanic has told me to get the AC General Manager to ring him so he can tell them the problems as I haven't got a clue.

Will post back tomorrow when I have been and let you all know. I just hope they play fare and allow me to either exchange for another Astra or give me my money back.

They already refused to give me my Peugeot back, that was over the telephone when I first got told about the problems!

    Thanks again.

Sounds good. If they try and offer you another car, get your mechanic or someone who knows about cars (even if it means paying RAC) to inspect it before they try and offload some other rubbish on you. Paying £150-odd for an inspection is nothing when you're handing over more than £5k!

I thought it wouldn't appear on the HPi register if it hadn't been subject to an insurance claim.
    ML.

If a car has had a accident claim against it, it wont show up on any HPi heck, unless the car is written off as Cat A, B, C or D.

I have a similar situation just starting.

Bought a car with Full Service History and upon checking the book in more detail, its missing one which invalidates the warranty. As well as a few other minor issues with the car which I wanted done, they decided to test me and offered a full refund.

I accepted (they seemed shocked) and asked for my money back. They then changed the tune to 'buy the car off me' at my loss.

Needless to say, i called Trading Standards and my Bank (paid with CC) both of which agree with my complaint and I have sent a letter rejecting the car today.

The experience over the past few days has been terrible, but ill be damned if im letting them away with it.

When I read these stories, Im so grateful that I may have paid a bit over the top for an approved VW from a main dealer.

When I read this stories I'm glad I never pay more than £300 for a car! (maybe £500 if I really, really need a car.)
