    Has the Summons to attend been served upon you yet? It should be the Court that serves it - not the police - and it should be at least 7 days before the Civil case is to be heard - see

    And I think the fact that you will be 39 weeks pregnant is sufficient reason to request that they take a deposition instead! Seems a trife odd to me, the way it is being handled....
  • Thank you everyone for the response. I have rang the CAB, who said in quite simple terms, I don't have to attend, there is a procedure, they are finding out about it and are calling me back. :j

    I also have my GP calling me this morning to talk about a doctors note to prove I am unfit to travel due to illness and pregnancy (was only seen yesterday by a GP as I have a bacterial viral infection and am on antibiotics)

    I also found the phone number of the murder squad DS who first turned up at my house last year when they needed a statement, waiting to hear back from CAB and then if needs be will ring them....

    seriously annoyed at this, Ok I knew this man years ago but the incident was like 2 years after me and him split up, I have not had any contact with him since we split, just because he is accused of murder means me (and others i expect!) are being dragged around the UK to travel to court cases regarding a child that I have never even met!
    And this isn't even the criminal case yet that doesn't come to the old bailey until later this year, have had a letter already warning that the case is likely to take 3 months over summer and to not make any plans, there goes my summer holiday :rolleyes:

  • well the gp was useless, said I was only going to be 40 weeks pregnant and thats no excuse not to travel to court, despite it being so far, he said its not like I was missing a leg :rolleyes: he agreed that he would write a letter stating how pregnant I was and that I was currently being treated for a bacterial viral infection but said he can't write anything else because he doesnt support my decision to not want to go to court.

    CAB were great, very interested in the case, said they dont get many murder case enquiries :rotfl: the solicitor told me the procedures for not attending the civil case regarding the residency of a child involved in the criminal case, I could still be summoned officially but they have to give 7 days notice of that, he said to speak to the person how has asked me to go, give my reasons for not going, ask to do a written statement (they already have this) and then if I don;t get very far, to write to the court clerk outlining my decisions, he said I cannot be held in contempt of court if I have informed them that I am not attending.
    So potentially I may have to attend at some point, but not next wednesday :T

    Your doc sounds a bit of a !!!!!!, though. :rolleyes:

    I spoke to the police this morning and social services, they have asked for doctors note, i said I have a note stating how pregnant I am and that I am currently being treated for a bacterial viral infection. She said that I need it to state that the doctor says I am unfit to travel to court, so looks like I'm going to try and speak to a different GP on monday to get another letter :rolleyes: Am going to make an appointment with mine and say I am stressed to the max, which tbh I am with all this!

    But if all you have is a call from the police, then I don't see you have to go. It should require a witness summons from the court surely.
