Bottom line if you are now happy with what you are getting then move on. Some battles are worth fighting some probably aren't.
Sounds like you have been played possibly by the landlord so its whether you can live with that and chalk it up to experience. Just make sure everything else is dealt woth correctly from start as if the LL will do this at the start of a tenant / LL relationship what else might he try on?0 -
Seems like the OP had set their heart on this particular place. The letting agent and the landlord knew this and took advantage of it.0

Obviously you like the house and the garage is not key. However, you did have a leg to stand on to get your fees back and then move on to the next house. Basically, you applied based on what was advertised and that changed after you paid. To me, a garage adds either car space or storage space or whatever, but it adds to the appeal of a house.
Personally, I wouldn't trust the EA or the LL in this case and that would make me not want the house. I agree that they took advantage because they knew you wanted the house. If they had to take 50pm off then it was either too high, listed it at a bad time, on the market for too long, or not enough interest in it. Either way, it was underhanded what the LL did.
If your EA used Right Move, do a search and tick the box to show let agreed. This will bring up all houses agreed on but do it quickly. It should be the original that you agreed to.0 -
It may very well be that the owner renting out the garage separate to the house is a breach of planning control too. Is it part of a new development? If so, there may very well be conditions restricting the use of the garages to only be used for parking in connection with the houses they are associated with. Even if there is not, there may well be a case to say that the house and garage formed one planning unit and by separating the garage from the house (in terms of use), a new planning unit has been created, thereby requiring planning permission. Without knowing all the facts and the respective locations of the house and garage, it's difficult to confirm this - it's not a cut-and-dry case, but if you want to follow this up more formally, you could seek the opinion of your local planning authority.0
