House we have agreed to rent now has no garage with it, where do we stand?

    I was in a similar situation where the EA made a major c**k up and we were refunded our fees, however, we are not moving into the property either.

    I think if you move into the property and accept that the garage isn't included, then you shouldn't get your money back because the fee covers the application and credit checks.

    Another thing to consider...how close is the garage to your front door? Can you park in the driveway or is there a spot next to it so the renter of the garage has full access? If it's well away from the property then I wouldn't have an issue but if it's next to it or attached then I wouldn't want someone walking around my property. Don't know what the renter intends to do with it. Is it just for storage of is he planning on fixing up an old car at 11 O'clock at night.

    I would ask a lot of questions before you decide.

    I took legal advise and they said we ain't got a leg to stand on.

    Luckily the garage is right away from the house so that's OK.

    I spoke to the estate agents and they said he won't come down on the price as he had already dropped it by £50 a month which is fair enough. It's a really good renovation at a good price so we have taken it.

    I ask the agent why he had let the garage and she said it was the first they had heard of it so he should have told them.

    He's obviously done a snide by renting the garage separate to get the money he was after.

    There is other places to park so it's not the end of the world

    You most certainly *do* have a leg to stand on, if you reject the changed circumstances.

    If you go ahead then you don't get the fees back as you accepted the change in the implied contract.

    Just got free legal advise so probably weren't the best.

    They said that as there was no formal signed contract between us that we wouldn't be able to claim the fee back.

    I'm usually a good negotiator but as I have no experience of how lettings work and how to respond to what's happened

    They have taken there fee and the house is off the internet.

    If you have any other advice then please tell me what your next move would be?

    An earlier poster said seek legal advice which I done and that's what they have told me

    I'm completely confused as to what you actually want here
    (a) your holding deposit returning and not to take the house
    (b) to take the house without garage at a reduced rent
    (c) to try to insist upon a garage being provided as per the original agreement.

    Fire Fox....We still want to rent the house but they said he won't drop the rent as it's already dropped 50pm.

    The garage is being rented out seperatly now so I can only pressume they dropped the price and he rented the garage seperatly but they forgot to update the advert to say the garage no longer came with the house.

    Dvardysshadow. WE didn't take a shot, saved in the favourites and now it is showing as off the market with no info on garage.

    Evan if I had that, what could I do anyway? They won't lower the price and someone else would rent the house, perhaps I'm looking at it the wrong way but I can see what I can gain now, they will take the admin fee cause we are moving in and they won't drop the rent so what can i do.
