    in fact there is a template to block their coming to your door at all.

    Where can this template be found or can you provide a link to it please.

    is this actually a bailiff company or is it one of these letters that are headed up all fancy but in reality is just a fictional paper company set up by a DCA??

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

    There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

  • Hey there - I too have received a letter from Philips Bailiffs claiming I owe a debt to Lowell Financial for the outstanding amount of £25.81. I too have no idea how this debt could have accrued, especially since I closed my financial affairs in the UK at the end of 2006 before leaving for a period of time. I note that there are no creditors in the letter and for a Non Counsumer Account. The letter demanded payment within 7 days of the notice to prevent further recovery procedures commencing.

    I've sent them an email asking them to provide proof of the debt and how the debt was acrued. Their response - an automated email stating they will responde in 7-10 days (after their intention to commence further recovery procedures).

    I've already been hit by fraud on my overseas credit card with my card details being stolen and my account being used to purchase goods in China. So, as you can imagine, I'm highly suspicious of how two companies with whom I have had no prior dealings with can secure my name and address and I wonder what other personal details they have. Such was my concern that I went into my bank to seek advice just in case Philips or Lowell Financial tries to access funds from my account. Whilst there, the bank officer suggested we contact Philips to find out what the letter was about. The bank officer noted that the company seems to play a waiting game - you wait, you get sick of waiting, you choose to pay. Luckily, we eventually got through to someone who proceeded to confirm my name and my address. He then asked for my phone number so that he could look at the details of the debt. Needless to say I did not give him my phone number. I did give him the Philips Reference Number. But it appears their systems do not recognise this number when looking up a specific 'debt case'. The phone call ended with me saying to them that I have no hesitatation in raising the case with the Office of Fair Trading.

    This all happened yesterday (Friday). Prior to going into the bank, I did contact the Office of Fair Trading. I'm waiting for them to get back in contact with me (hopefully on Monday).

    Having read through the postings on this site and also doing a Google search on Philips - Lowell Financial and finding similar postings on Consumer Action Group I strongly believe that this letter is designed to phish for personal details about an unsuspecting individual and that the company could use those details to act fraudulently. I'm just about to call the police to seek their advice on the matter.

    I posted this on another thread earlier but feel it's relevant here too!! Sorry if I shouldn't do this!

    My partner is now having trouble with Lowell for a debt supposedly with O2 that they have bought.

    The first he knew about this was in November 2009 when Lowell sent him a chasing letter saying he owed £37 for an O2 debt, he rang them up and asked what it was about as he didn't believe he owed them any money. They said they would have to get copy records from O2 and in the meantime they would place the account on hold. They followed it up with a letter confirming the same. About a month later the same letter came through saying that they were still waiting for records to come through and the account was still on hold. so far he's had about 3 letters saying this. Having checked his credit report in February the debt shows on there as defaulted, so we wrote to them again saying please could they send records and surely it doesn't take 4 months to get these. They responded with a letter saying they were still waiting and not to contact them again or the original company owed money (O2)?!?! Since then another of the original letters have been sent saying they are still awaitng information.

    Sick of this my partner rang Lowell today and amazingly the woman he spoke to was able to give him the mobile number of the phone concerned (so he can make checks, if he does owe it he's happy to pay it but isn't convinced it's outstanding) previously they've said they can't give anything out, but wouldn't give him the telephone number for O2. We soon got this from the internet so he then rang O2.

    They said that the records no longer exist as the debt was sold to Lowell in 2007!!! so it's taken them 2 years to even make contact!!! he explained that Lowell told him they were waiting for the records from O2, O2 claim this can't be correct as when the debt is sold all the records are passed across too.

    He then rang Lowell back, the man he got this time agreed that 4 months is a long time to wait for records, and when he explained that O2 said they pass all the records to Lowell he denied this - so someone is lying and after seeing some of the information on the net about Lowell I would suspect it's them!

    Having seen all this good information we shall be writing to them again with a bit more legal jargon.

    I have a letter today sent to my address in my name (well nearly but surname mis spelled) with a debt of over 1000k from an address in Northampton ( I am in Lancashire now and have not lived in Northants ever!!)
    I have no knowledge at all of the debt and have only lived back in the UK since July after working all over Europe for 8 years. I called Lowell Financial and told them I have no knowledge but what do I need to do now to stop any further contact or letters?

    I have received a letter from Philips but for a large sum - £1370 chasing on behalf of Lowell.

    I dont have a clue what this is for, how is everyone chosing to deal with this? I have ignored so far not sure wether to send Prove It letter.
  • My OH also received a letter this week from Philips on behalf of Lowell on behalf of Littlewoods (work that one out!), claiming that he owes over £2000. We have no clue what this debt is and have sent a letter asking them to prove it. I shall be interested to hear their reply.
  • Littlewoods should be your first port of call - they will have details of any debt they have sold on to Lowell (or asked them to pursue) and should be able to tell you if your details match those of the debtor - if they don't, you have the answer to your question. Complain to Littlewoods that you are being pursued for a debt you don't believe you owe by a company they have chosen to do business with.
