DVLA - Failure to Notify Fine!!!!

    im sorry that u think i have a 'terse' attitude - perhaps it was an over-reaction on my part given my current issue/problems that i was not appreciative of the tone of some of the replies i had received, given that i was after all, just looking for some friendly advice and not to be told 'my own fault, deal with it'

  • perhaps everyone is right.
    i (and father) made what is conceived to be a stupid mistake in not double checking that the DVLA were doing the job by not ringing them up (and paying for the phonecall) to remind them to send me an acknowledgement letter.
    i further made the mistake in thinking that a simple explanation letter in response to the first notification letter sufficed in explaining i had done what i had been asked to do.
    i then made a mistake thinking that no reply from there after months meant it had been dealt with - again, i see that a call should have been made to see if they had done their job.
    i guess the only logical way forward now is to accept that i was wrong and that i should pay the bullying, incompetent govt dept the money they so desperately need.
    hurrah for the government

    Yep, that's right. YOU have to check that the DVLA that YOU pay for have done its job, otherwise YOU will be fined for THEIR incompetence. As Honest John rather eloquently put it (approximately :D).

    I'm sure the DVLA isn't the most competent organisation in the world, however, they do have a procedure (the confirmation letter) that is designed, inter alia, to detect their inadequacies.

    You didn't follow the procedures and it's now causing you grief.

    I imagine the DVLA hear the 'well, I posted it' excuse many times (and no doubt it is sometimes true).

    Are you intending to pay or fight?

    my point is still the same - why should i be the one forking out time/money/effort to check that they are doing their own job?
    its just a matter of principle - but i guess these days principles mean nothing if all i want is for the hassle to go away.
    i havent decided yet - but given most people's responses, am veering towards paying

    Because who else can ?

    Suppose your original letter really DID get lost in the post ? Then the DVLA have absolutely no way of knowing that you sent them anything. So they can't check anything.

    All they can do is send an acknowledgement (at their expense) when they HAVE received and processed something.

    It has to be the person initiating the process who either confirms that process is complete or, if not, queries it.

    Like slip was sent like, if confirmation like not received then you like need to follow it up like.

    You didn't like now pay the fine like.

    You get it wrong like so blame like someone else like.

    thanks for the good luck - having done some more digging, have found others who had similar situation and were successful at disputing the fine.

    Yeah, and you should also hear/read stories (in the same places) of people who have tried the tricks and lost. I have read into this issue a great deal, I know we don't have ANY threads here on MSE which have been concluded properly, that means no one has come back to say "I won" or "I lost" (in court). There are a few threads on that other consumer action board most (if not all) of which are not concluded. On that board the closest thread I found to have been concluded was a guy who said he had won using human rights act, I asked him for further information but he has never posted since (1 - 2 years now).

    Whatever people say these are the lower courts, and two defendants using the same arguement in seperate cases can get different results from the judge. As long as you understand there are no absolutes and it is a gamble then you will be in a better position to decide what you are going to do. And no matter what those people say in that linked thread (they like talking about the interpretations act on that board) none of them have any case law to back their arguments up, none of them can say
    "I did go to court and I did win, and this is how I did it."

    The only other type of concluded threads both here and there on this subject, are the ones who after writing to DVLA, recieved a letter back from DVLA saying "no further action".

    I'll also bet my bottom dollar that you also will not report back to say how you got in court.

    its fine. i get it. no point asking for help/advice etc when others quite clearly think i dont deserve it.

    Let me see if I get this right. You are saying I am 'like boring like' yet you still take the time to read and post a reply to the thread. Oh wait, it's okay, you didn't take the time to write a properly worded response.
