My husband received the same letter yesterday. He doesn't use the card anymore, actually doesn't have it, it was destroyed ages ago, we are just paying off the balance. Should we be worried, or just keep an eye on the statements?

You should be keeping an eye on the statements every month anyway. Everyone should be checking their bank and credit card statements on a monthly basis to protect themselves from fraud.

We have to do our part to beat fraud also. :j

  • Thanks for all the replies. I know that people can access my personal details via internet etc but i think its worrying me because somewhere on this laptop all my details are in one place making it very easy for someone to commit fraud in my name. Easier than it would be making calls and doing searches etc.

Im not fused about getting money from them i just want them to offer better protection than 3 months CIFAS and 12 months experian. Especially considering they have breached the data protection act by not safegaurding my details

Without getting too dramatic about it, I do think this is important. Some of this crime might be disorganised and be about individual crooks enriching themselves at everyone else's expense. At the other end of the scale there is large scale organised crime with much more sinister objectives, be it terrorism, narcotics, hard currency for dodgy governments etc. It's one thing getting cash nicked (who ever makes good the losses) but it's another thing when you think what pretty unpleasant activities it might be used for.

I would be happy with the 3 months CIFAS and 12 months Experian, because you know what, there is nothing else they can do?
  • I think that a large company such as MBNA should try and do more. The least they could have done was encrypt the data on the laptop. Which they did not do. I want about 2 years on CIFAS to protect me becuase 3 months is nothing. Its crap.
  • How is the award say of £250 as a poster suggested make your account security any better than it is now????
There is no loss up to now but if you want to punish MBNA well isn't that how the bank charges fiasco started?

    Hello

Yesterday i recieved a letter from VIrgin MBNA credit card. It said that some of my details may have been breached
    - Name
    - Address
    - Mothers maiden name
    - place of birth
    - Credit card number

they have offered experian free for one year and CIFAS for three months.
Im really shocked because its my whole identity that has possibly fallen into the wrong hands.
I have read that they have had a laptop stolen 2 weeks ago with customers details. Presumably this is how my details have been breached. What should i do???
    Please help

    Lisa :O)

this happens all the time with business laptops. Nationwide, The Met, National rail have all lost laptops with customers and staff members details on it. Don't panic too much, take mbna's offer of help and set up a password on your credit file thru cifas- it will last 13 months not 3.
  • Brilliant thanks. So if i set up a password on cifas does that mean that if anyones tries to apply for loan etc they wont be able to :O). I hope so. Thanks.

Im not to sure what the £250 award thing is going on about. I dont want anymoney. I just want to protect myself from fraud as i feel the laptop has exposed everything about my identity all in one easily accessable place.

My experience of dealing with the Financial Ombudsman Service is that where a customer has had their personal data compromised in this way the card company would be obliged to make a not insignificant compensation payment if the customer pursued the complaint via the FOS.

That's not to say that the firm should automatically be offer it, but where a customer rejects the initial offer (which is, let's be honest, the absolute minimum that they should do given that they've messed up) there is only one way to go - and that is down the ex-gratia payment route.

If you don't want to go down that route, that's your choice and is fine by me. But ultimately you've been wronged by this firm and you're not properly holding them to account.

It isn't. How is sending a murderer to prison going to bring the victim back to life?

I don't see how an ex-gratia payment for distress caused by a data protection breach has anything to do with the bank charges nonsense.

I normally agree with most of your posts, but on this occasion I'll choose not to.

Every time you apply for a credit facility the lender will see that you have been a victim of fraud, known as category zero (0) and will conduct further searches regarding your id, even if a fraudster has obtained documents (eg passport) with your details with out the password no further facilities will be granted. By checking your credit file every month you will see what applications are being made in your name and if any are being made by a third party you will be able to contact that company directly ( you will see the applications being made from a different address, and this wont be the first time that the fruadster has used this address so every credit provider will be on guard all ready )and advise them that you have not made the application. These are just for precaution and it is unlikely that anyone would be using your details and I wouldn't worry too much about it.
