I phoned the FOS, and they said that if they hadn't paid up then the only way I can refer it back to the FOS is if I complain again to the bank. The bank in question is Barclays. I am in contact with the FOS regarding an ongoing complaint (two years and counting), I have mentioned this to the adjudicator looking into the case. Will see what he says. I am really unsure why they can demand payment there and then, yet I can't demand a payment they have agreed to make.

I have another complaint, about the same bank with the FOS, an agreement was reached SIX months ago, and they have still not acted on what was agreed, they claim I owe around 1500 more than what I do. The loan that was in question has now been paid off in full, but they are still trying to force me to pay the 1500 that I don't owe. I have never missed a payment and sent an email to the adjudicator yesterday with regards to prove that I have made every single payment, I managed to scan every single statement over the course of the loan in one day!!! I have also asked them why they are failing to act on an agreement that was made.
The complaint regarding the PPI was a separate complaint, I phoned the FOS when after two months I had received nothing back. I did not pass this to the adjudicator initially. I have now informed the adjudicator about this PPI case, he has commented he can't comment on this as it is another complaint, this complaint is not with the FOS, but B******s are looking at bunging the PPI offer in with the new offer they are going to make with regard the original complaint. It is getting way to confusing for my liking!
Which CEO would I contact, the FOS's or the Banks. With the PPI I was in contact with someone in the Chairmans office, as I sent the initial letter to him as I know what a waste of time the rest of the organization is.

I was told 29th of March that they will be in contact within 14 days. If I have not received payment by April 12th I will be sending a letter to the CEO, if nothing by the April 28th I will be going to the small claims court. They agreed to pay it back in January. So by the time that comes it will be almost five months since they agreed to make the refund.
In the letter I am going to send the CEO I am thinking about requesting 30GBP administration fee for late payment, does anyone think this would be a bad move?
As I said the reason I have been given by someone is the FOS is they have tied this in with another complaint I made, as far as I am concerned these are two separate issues, so I have no idea why they are delaying this.

I agree with you, with it being another separate issue, it should be dealt with it separately.
I would write whatever it takes, and maybe state that you have intentions of writing to the FSA as well if this is not resolved very soon, hopefully the CEO will push this for you.
Its unlikely though you will hear from the CEO direct, but you may find that you will receive a letter from the banking group to confirm they are aware of your letter/email to the CEO which have been forwarded on to them to deal with, so where-as the CEO are pushing them to get on with it.

Will contact him on Tuesday. I normally send letters/emails to the head of companies, never get a response from them, but I suppose us mortals aren't good enough to talk to them directly0 -

Good luck with this, they will know you mean business now though by getting the CEO involved.
Your right though its rare they main head offices or the CEO gets back but hopefully this will get moved along quicker for you now.

OK, I have sent two letters, one directly to the person who sent the letter saying they would repay, and a contact I had in the chairmans office. I sent the initial letter to the chairman, and this staff member was assigned with the case.
I have asked for either full payment, or an acceptable explanation as to why they are taking so long. I thought this would be the best way forward as if I do take this to court I can argue that I did offer them to give a justified explanation to the delay for the payment. I have given them until April 21st to provide full payment or justification for delay. I have also "requested" an extra 30GBP for administration costs due to the delay, if you don't ask you don't get. Will see what happens. I sent the letter on the 6th April. I am away on the 21st but they don't know that.0 -
