Dell will not cancel an order for a system not yet delivered

    I came here looking for helpful advice, and am shocked at the animosity.

    e.g baiting by one person attemping to have 'good fun' at my expense, and another saying although I was told I could order in business as a private customer by a Dell rep I don't have any proof and you'll be glad if I pay the price for it.

    How do either of these attitudes contribute to make this a helpful site?

    I cancelled the next day by the way, before the system was even a twinkle in anyone's eye.

    Why didn't you when you realised you had made a misteke request changes to a spec. you wanted rather than trying to totally cancel?

    I think you have a fight on your hands. Dell have never liked giving money back so much so that the OFT had to have words a few years ago.

    You are a consumer but you have effectively declared yourself as a business user by using the Dell site for businesses. That said you are still a consumer and not a business something you have made clear both verbally and on your order form. You have also cancelled within a very short period of placing your order.

    If it came to court I think you have a reasonable chance of winning. However reasonable is a word that makes lawyers money !

    You, I repeat YOU placed your order in the wrong place and you have to pay the consequences.

    If I had accidently ordered the wrong spec. I'd have asked to change my ordered spec. and not contact them wanting to cancel...why did you?

    Usual crowd out I see.

    Dell's T&c's define
    Business User: legal entity or person who buys or agrees to buy Products &/or Services from Dell other than for private use

    Doesn't state which part of the website you have to use, or how you have to register. If you stated you were a home customer, take it further.

    No, their t&cs allow it.

    Whether the OP purchased in the course of a trade or business is a matter of fact.

    What Dell says doesn't mean a jot. They cannot take away statutory rights by means of contractual terms.

    DSR will apply (unless a custom build).
