    That has outlined what i have told you, but in breif misleading detail.

    Ignore the refund/repair part as you have had reasonable time to inspect the goods under soga and cannot "reject" them, which is what it refers to.

    As for the repair/replace part, its what i told you, YOU CANNOT INSIST on which one, they can chose. Simple as. Or chose to ignore it and shout about something you have no idea about and happen to be wrong to another human being, who by the way is not at fault for the issue. But hey what do i know about politeness?

    Go to consumer direct for more info. They should and will back up everything i have told you and will direct you on how to deal with it, however once again, microsoft direct will be your fastest option.

    Point is thought they shouldn't have refused to deal with it either way. The were obliged as I said to follow through on it, not fob me off with garbage about how they couldn't deal with it and it's microsofts problem.

    Also, Microsoft DO NOT repair e74 consoles. If the cosole is within it's initial year, they issue a new console. If it falls out side the year and into the extended warranty, they issue a refurbished replacement. That is there active practice in cases of RROD.
    There's loads of info on xbox.com about this.

    Edit: To add, e74 is 90% of the time caused by bad soldering around the hana scaler chip. This chip isn't soldered using normal methods. To resolder would require reballing the solder wich costs about as much as a new console, hence the refurbished or new replacements.

  • Because I've got to then explain to my already upset 10 yo son that he needs to wait even longer for his christmas present. Simple as.

    Look, Tesco regularly take back faulty tv's, dvd players etc and normaly issue refunds or replacements on the spot. I've watched them do this in my local branch for a couple of years. I recently got a replacement for a faulty dvd player, nearly 9 months after i bought it.
    I've never heard of them doing this before. They can and normaly would replace this. On the spot as well so.. Why me? Why now? Why a kids christmas present?

    Besides, the person I spoke to couldn't give a damn. He would rather fob me off with garbage. I don't know what makes me more angry. The fact that he fobed me off with lies or the fact that he did that knowing full well that it was a kids christmas present. Remember, he didn't advise that going to microsoft would be the best thing to do. He litteraly told me Tesco had no obligation in this.

    Ultimately though, irrelivent of what that idiot says, I'm taking this console into my Tesco branch tommorow and I bet you anything that I walk out with a new console.
    What the support line says is not how staff in the shop normaly see things. ;)

    Hudson, you really should stop being so abrupt with people on MSE. There is no need to say that what people type is rubbish. Just explain why it is wrong. You are coming across as a bully and as very arrogant when you say you had their best interests in mind. Something of a rarity on here

    Well, just to pea on Hudsons bonfire some more. Joseph, you are correct, your contract is with the retailer, forget about MS, stick with dealing with Tesco, if you were to have any problems with MS you would have next to none consumer protection.

    I can't see why you can not reject the goods as not fit for purpose and not durable. Your first oppertunity to inspect the goods was not until the 25th Dec or later, therefore the goods have failed within a very short time.

    It sounds like the CS rep at Tesco were mixing their T&C's with the SOGA and came up with junk. If they continue to mention their T&C's just ask them to look at either the first or last point (it is normally one or other with most retailers) and get them to repeat it to you, the part about "THIS DOES NOT EFFECT YOUR STATUTORY RIGHTS".

    Keep pushing them, and if they persist just start small claims court action.

    I suppose it depends how long you want to wait to have this problem sorted, you could fight your way through Tesco and make them do it, but i guess it would take months, or you could phone microsoft tell them the problem, they will send you a postal label, you put your xbox in a box and wait for the courier to collect. 2-4 weeks later they return your repaired or replaced xbox 360 and you can continue gaming. Why make it any harder than it has to be. BTW microsoft has the choice to repair or replace, and 99% of the time they will repair.

    Sorry but you are incorrect, I have personally had 2 xboxs with the E74 error one within 4 months the other at 6 months, both times it was repaired. My friend also had the E74 error on his after 6 months and they replaced with a refurbished model, which he refused as the refurbed model was 12 months older than the one he sent in for repair, they repaired his and sent his back.
    I have also had RROD again not replaced but repaired and that was within the 12 month warranty period, im not waiting for 2nd xbox to get the RROD which is out of the 12 month warranty but covered by the extended warranty for RROD.
    Everyones opinion is the most important.....no wonder nothing is ever agreed on.

    Why? Because what has stopped you swapping the xbox over with a banned console after the last few months of banned waves? They want you to send it to microsoft as they know if its genuine it will be repaired if its a banned console it wont, I suppose they are protecting themselves

    Microsoft will have it back to you within about a week.

    Of course, if you want to go via Tesco, spend some time arguing with them before realising they have Microsoft as their repair agent anyway and then getting Tesco, who are famous as a food retailer rather than a games console retailer, to organise it, you could have the console repaired/replaced in double the time.
