3 1 month mobile broadband contracts

I took out a 1 month mobile broadband contract and seperately, a PAYG modem with three.
I sent back the PAYG modem for a refund, and then gave 30 days notice on the contract. After waiting a month for the refund, I contacted them and they have been withholding it because I didn't also return the modem from the contract. I'm not obliged to am I? It makes no reference on the site that you are only loaning it for the duration of the contract and not actually buying it.

Does it say anything in their terms and conditions about it? Check the contract you signed when you got the modem. Also you probably paid £9.99 for the modem so if they wanted it back, make sure and ask for a refund on that.0

It says nothing about it that I have found (they keep insisting they don't have to tell me when I buy it as its in the "legal script" when you call up and cancel! So basically you only find out once you've already agreed to the contract and can't do anything about it!).
My only issue was getting the PAYG modem money back, and half way through the big ramble about how its standard to return a modem if you finish the contract, she randomly said she could refund the PAYG money into my bank account.
Further to that, I went on three's website and asked their sales "experts" if I have to return the modem after I give my 30 days notice and they confirmed I didn't!
Their department is a complete joke - the woman I was talking to was also under the impression that if you took a 12 month mobile contract, you aren't allowed to cancel them until you return the original phone! And these people work in mobile support!
At least the people dealing with the contracts know how they work! They haven't been charging me at all for the contract even though they insist it isn't cancelled as I haven't returned the modem!0 -
Give them another ring and see if you have any more luck with another advisor. You paid for the contract modem so it should be yours. Stick to your guns with them.0

Yeah, I might just ignore it now they've finally given the refund though. They claim they want the modem back but the pay monthly people consider my contract to be ended.
I might return it anyway as its a lot harder to unlock than I expected at the time (the only way I can see to do it requires Windows XP). I will only do so on the condition I get the £9.99 back though! Don't know if its really worth it after all this though! (They spent half an hour denying they ever received it and the tracking number I gave them was the one for the delivery to me - even though its clearly on a receipt that I posted myself listing their address!).0 -

What has Vofafone got to do with it? Maybe you have got to the stage where you just assume all complaints are about you.0
