Black Horse PPI Claim Problems

I could do woth a bit of advice please.
I am trying to claim back PPI which I was told I must take in order for me to secure a loan from Black Horse on 3 occasions from February 2004 until July 2006.

When I initially sent of my 1st letter I received a response advising me that they could find no details for me on their systems and could I provide the Agreement numbers.

As I no longer have the agreement numbers I sent a SAR with a £10 cheque to cover admin costs.

I received a raft of information from Black Horse as requested in the SAR however the details they have sent me belong to my Dad !!! Loan account details, bank account details, copy of passport, copy of driving license etc etc. 1st off I am sure this is against the law and wonder if there is anything my Dad can do about this.

Secondly I rang Black Horse to advise them that they had sent my my Dad's details. The girl I spoke to then searched for me on the system, again advising I didn't exist.
I then asked her why there were 3 seperate account entries on my Experian Credit report detailing the loans I had taken out with there company, She put me on hold for about 10 minutes and returned advising that she had now found me on the system and would send out the information by post, this was on 11th December 2009, I have still heard nothing....

What should I do next ????

    Firstly I would send them a letter about their mistake and tell them you are complaining to the ICO about this. Secondly I would send another letter about your telephone conversation (with dates and times if possible) and send by recorded delivery stating they acknowledged you then and you are wanting to make a complaint over the misselling of your PPI on your 3 loans. I would just give them 8 weeks then like any other complaint and then take to FOS if necessary.


    Always send everything recorded delivery also so you have a proof.

    Blimey what a botch up.........:eek:

    Strange before you mentioned about the credit reports that you did not exist and suddenly you do...whe you told them.


    Give the Information Commissioners Office (ICO) and ask advice from them, they may advise you complain about this or give you other leads.

    Tell them everything as you have above.

    In regards then of reclaiming (if you can get hold of the account number for this, you may find this if you were paying out of your bank account by direct debit, on old bank statements, or if you bank online this should allow you to go back about 6 years.
    Just as long as you do have the account number you can still continue to reclaim.

    Does this look about right for a letter to send to Black Horse regarding the issues I have experienced here

    Dear Sir/Madam

    I am writing in response to a Subject Access Request you recently completed after receiving a request from me.

    I enclosed a cheque to the value of £10 to cover admin costs which you have duly cashed and you have then sent me all the information you hold including copies of both driving licenses and passports along with numerous different bank account details for my Father Mr xxx.
    I am currently in the process of complaining to the ICO about this as I am pretty sure that this is a breach of the Data Protection Act.

    Further to this I contacted your customer services department to notify them of this mistake and also to request that you send me all the information you hold on me Mr xxx. as originally requested, I have enclosed my original SAR Letter for your review.
    When I finally got through to speak to someone called XXXXX at 11.30am on 11th December 2009 firstly the advisor was not in the slightest concerned that I had received personal information of my fathers, secondly she told me point blank that there was absolutely no record of me on her system.
    I then went on to ask why then there were 3 account instances on my current Experian credit report detailing 3 separate loan agreements held with your company between 2004 and 2006 (Copies also enclosed with this letter for your review), Lisa then put me on hold for about 10 minutes before returning to advise me that she had now found me on the system and would forward all the information out in the post.

    Well as of today I have still received no correspondence from your company regarding the information I have requested and also paid your company £10 for.

    I expect and immediate response to acknowledge receipt of this request and to comply with law I expect to receive the information about Mr XXX as originally requested promptly and within 40 calendar days from receipt of the letter.

  • Nothing received back through the post from Black Horse Yet. 42 Days gone now since they recieved my letter via recorded delivery!!!!
    Just spoken to them on the phone and they are unable to find my details on the system as their computer systems do not go back as far as 2004 - 2006 !!!!
    The lady said she would trace the whereabouts of my letter and make sure it was being dealt with correctly.... I am not holding out much hope though !!!!
    Any Ideas People .......

    Hi there

    Did you post by recorded delivery?
    If so and you still have the ref tracking number check it out on the Royal mail website tracking, it will show the date delivered and hopefully the name of the person who signed for it on delivery.

    You can then if you want to get back to confirm this to them.;)
    And also give them the tracking number.

    Gave them the date, time and name of the signee and also the tracking number.
    Guess I will just have to sit back and wait.......
