Someone making a false claim agains me...

I wonder if anyone can help. I live next to a Primary School and my house sits alongside a small private car park (which residents have permission to use, as well as have right of way over to access our driveways) but as you can imagine, being a stonesthrow from the school, gets used by parents at 9am/3pm.

Anyway, back in April 2009 a policeman knocked on my door asking me if I had hit a lady's car who works at the school, as someone had hit all down one side. I said sorry, I didnt and couldnt help as I didnt see anything. Thought nothing more of it.

Sep 2009, knock at the door, this lady I dont recognise appears at my front door. She accuses me of banging her car, she says it was a silver car that did it because they left silver paint on her car, and as my car in silver, and has numerous scratches on it (from an accident I was in in 2007) it was categorically me. I said Im sorry, she's put 2+2 together and got 5, it wasn't me and that it could have been any number of parents at 9am, and in any event its a private car park and she shouldnt have been parked there in the first place. She continued to pester, her insurers contacted me, I said the same thing - it was not me, I have no idea who it was.

Anyway, I thought that was the end of the matter until November my car died beyond repair. My father in law has lent me a courtesy car from his garage, so I cancelled my insurance policy to save some money. I was due about £180 refund as Id paid upfront - but was told there was a pending claim against me and they couldnt give me any money back until this ladys insurer confirms they are dropping all pursuit of a claim against me. I told her it was a false claim, she said she couldnt take my word for it.

I asked how long it will take, she said there is no obligation for this ladys insurers to complete their investigation within any certain timeframe - so its been 2 months already, it could be another 2 months, 6 months, 2 years.... my insurer says they are powerless, her insurers wont speak to me, and all along this is a totally false claim and Ive done nothing wrong, and desperately need that £180!

Any advice???

    Counter claim against her and say she hit your car.
  • Like both ideas, but really cant be bothered, I just want my money so I can pay off my Christmas spending from my credit card :-(

    i wouldn't have thought this is sensible because effectively you would be confirming that both cars did come in contact with each other. If each is denying liability it's likely to go 50:50 and probably premiums will rise? Hopefully someone with some better insurance knowledge will come along. I can't see how they could prove beyond doubt that it was your car.

    My first thoughts are this, I would discount relevance of entitlement to be in car park for the moment.

    Concentrate on the constabulary aspect. Did the visiting constable say that you or your car have been identified by a witness as being involved in this alleged accident?

    or simply that it has been suggested that you are involved?

    If someone is claiming that you were actually seen then you need to prove your exact whereabouts at the time of the incident. going through, reciepts, phone calls, appointments will help.

    I would have thought that if they took samples of this silver paint residue on her car, it would give an indication of the make of car involved, either ruling your car in or out.
  • Hi thanks, no she isnt claiming that anybody saw me and if my whereabouts were to be questioned I would have almost certainly have been at home, since I work from home and am at home nearly all the time. The police officer never said I had been seen, he simply said he was making some enquiries, that someones car had been by a silver vehicle and that he noticed I own a silver vehicle and was it me.

    No samples were taken of paint, and Im presuming 8-9 months down the line after she's had the scratched repaired, that it would be too late?

    Im surprised the fact she was illegally parked, on private land, that has a big sign up saying "No Parking - Strictly For Residents Only" would count for something, but either way Im more annoyed that I had nothing to do with the car incident. Working from home and living right next door to school I rarely go out in the car!

    In what way is it "illegal" to park on your private land. :rolleyes:
  • Wouldn't the fact that she was parked illegally void her insurance?

    Hmm maybe not illegally, but parked in a place without permission? Trespass?
