is this grounds to cancel my contract?
Hello,
I went into fones4u in October 09 to buy out my orange contract and get a new contract. I was on the dolphin 25 contact with orange but kept going over my minutes and using my phone for the internet and ended up with £50 - £60 bills each month rather then £25, I said to a member of staff that i want a contract which everything is included so i CANNOT go over, they provided me with a new phone and a contract with vodafone for £45 a month inc VAT. with 900 minutes, unlimited texts and internet. However when i get the bills through they are usually about £50 once they have added VAT to the line rental? yet on my agreement with fones4u it states includes VAT. is this means to cancel my contract? I wouldnt mind keeping it but i have no signal at my home address and even though they checked it and it says signal is good, it is not and they just called me a liar when i called up within seven days to cancel and told me i was to keep my contract as signal is good at my home address?
I then called up 14 days from the beginning of my contract and they told me i was out of the cancelation period even though i had tried within seven days, and they told me on that phone call i had 14?
i would appreciate anyones experiences with canceling contracts and if there is anyway of being able to cancel it without effecting my credit rating. Thanks in advance

you have 14 days to cancel. i have my vodafone contract in front of me and that's what it says. if you can prove you called them within that period, and they agree it was the 7th/14th day or whatever, then threaten them with the ombudsman.GREENS M'SHIP OFFER NOW CLOSED SO PLEASE DON'T ASK ME!Olympic Debt-free Challenge £2150/£11900 = 18.0%NOW INVESTIGATING AN ALTERNATIVE TO MY IVA - I WOULDN'T RECOMMEND ONE ANY MORE!0

Make a point of going in when it is busy and shouting at the top of your voice about it.0

Whilst shouting in a shop is usually a good idea to get attention I'm not sure three months down the line you'll have much joy.
If you have it in writing about the VAT send a copy of that back to P4U and try that.
In terms of cancelling you have no legal right to cancel if you order in the store, other than if the company offers that over and above what they have to. Unlike online or phone orders there is no cooling off period in law for an instore purchase.
However if you were specifically advised you had service you may be in luck, if they logged the call in the first 7 days under a networks performance promise but again you've put up with it for three months so you probably can't cancel on those grounds now.
Sorry it's not better news, the mis billing may be easily solved, but complaining about lack of service after having the phone for three months may be difficult to get anything done about if nothings recorded in your file.0 -

You can't cancel a contract once you have taken it out at Phones4u apart from exceptional circumstances. They stopped the 14 day cooling off period in August 2009 and it does state on the "are u happy" sheet that there is no cooling off period.
