  • thank you for the pointers. Unfortunately i do not have anyone to go with, my mum is ill herself and my sister is in the states. Will this go against me? Would it help if i just say someone has acccompanied me on the bus and is meeting me after?

Why are they failing so many people, what is the point in us having to go through the assessment for some other person in another office to decide that they arent gonna leave your claim as it is.

What happens if they do make you go on JSA, is it a simple cross over or will there be more delays in benefit payments??

    Thanks again everyone.
  • I had my medical today. Nightmare journey there and back (7 hour round trip due to snow). The nurse doing the medical was perfectly pleasant. However I hear pretty much everybody fails these medicals now anyway and is denied benefits.
  • so if we fail, and appeal we are likely to carry on getting our benefit?? But if not how do we get onto JSA, is it a matter of just phoning up and making a new claim. Its all soooo stressful, more delays with money, its hardly like whilst receiving the amount of benefit we do we can save money in the mean time just incase out money is delayed at some point!

I don't know! Personally I could not apply for JSA as to apply for JSA you have to be available for and fit for work. In my case my psychiatrist and GP have categorically said I'm not capable of even part-time work so by pretending I was capable of it I'd be lying.

So if we are truthful with the JSA people I'm presuming we wouldn't be allowed to get JSA.

As soon as you appeal you go back on the assessment rate of ESA till your appeal and if you win your appeal you will be paid the balance between that and the rate you win on appeal will be paid as a lump sum.

My husband went from 0 points to the support group after our MP stepped in and it only took a few weeks.

It would be ok to say someone has accompanied you on the bus and is meeting you later if it is true but if it would be a lie I do not think that would be a good idea.

Although the Doctor does not make the decision the DM usually follow what the Doctor has said when making their decision.

I do not know how long it would take for a claim to be processed for JSA, I get the impression it varies from area to area but with the way things are now I think delays are more likely.
  • thats what i mean heros journey, i want more than anything to get back to work, but no full well at the mo i would not be capable of holding down a job as my symptoms vary from one day to the next. So if i had to claim JSA, i would be lying and unable to work!

So basically if you fail, you call them straight away stating you wish to appeal? and then you will stay on the same rate of ESA you have been getting until your appeal date? And then what happens with any benefit owed to you as i thought from week 14 of being on ESA you are put into one of two categorys? And get more money? Is this then backdated?
