transfer of ownership

Our mother's house is valued at £60k, there is no mortgage.She is signing over ownership to me and I have agreed to pay my brother and sister £20k each, no mortgage involved. My mother has a solicitor who is dealing with the transfer. Do I need a solicitor to act on my behalf?

  • You will need to complete the AP1 and ID1 forms and submit them to the Land Registry. As there is a family connection here, cannot the same solicitor also act for you as well?

  • Trying to avoid legal costs. Can I get these forms and complete them myself?
  • Yes, you can download them from the Land Registry - the gov.uk site NOT any others that pretend to be the Land Registry.

    The ID1 form requires you either to get a solicitor to certify the ID of those concerned or you have to go to a Land Registry to do this. You have to weigh up whether the hassle of those involved going the Land Registry is worth it to save some legal costs.

    My husband and I are divorcing and we own two properties. We are tenants in common for the main one and I want to transfer my half to him. The other smaller property is in his name but he will transfer this to my name only. Can we do this ourselves through the Land registry? Both properties are registered with the same land registry. Would this be legally binding as part of the divorce which we are doing ourselves?
