    I don't know the rules, but I think the OP's sister ought to find out and get her story straight. (E.g. she might have been hoping for a different prize - for example first prize is a Wii plus game, runner up prizes are the game. She enters because she wants to win the Wii but wins a game. Without a Wii it is no use so sells it.)

    Maybe entering a competition with the intention of selling the prize isn't classed as trading, but if it were me about to be investigated I would want to know either way.

    Its not just her guilty of that though I myself comp just to sell the prizes its what helps me pay the bills and a lot of compers do the same. For the person who said she cant be luck enough to win that much, well she doesnt enter as many as me but in the 18 months ive been comping I have won : Tinkerbell doll, pet shop stationery, 3 disney dvds, £200 of kids books, 2 x signed jacqueline wilson books, 2 rimmel foundations, rimmel lipstick, watch and necklace set, psp, sony ericson phone, little princess bookset, thomas books worth £30, 3 thomas wooden trains, wooden charlie and lola house and garden set, 2 xbox 360 games, baby show tickets, £50 amazon vouchers and countless dvds.

    I too didnt think this would be classed as a business as its not been bought to be sold on, its runner up prizes, prizes that turned up after the items been bought, have no use etc. Not all prizes are sold but whats the point in keeping prizes for the sake of it or binning them when you can make money out of it.

    Shes not organised at all so I will have to pass on the comments and go through it with her

    For tax purposes it is different.... and that's all that matters here.

    I've been roprted twice now to the dss (i'm on incapacity benefit and make jewellery as pary of occupational therapy for cerebral palsey) I'm allowed to earn £20 a week on my earnings which i don't, anyways i was reported for the second time in nov and had my incapacity payments stopped until i could proove that i'm not earning thousands, now i have to send in regular invoices so they can keep track of my earnings

    plus the dss do look into ebay thats how i was cought the 1st time (although i knew i was allowed to earn £20 a week occupational therapy) i didn't know i had to sign a form to allow me to do so,

    If you buy something for your own personal use, then later sell it, then that is a private sale. If you buy something with the intention of selling it on at a profit, then it is a business sale.

    As other posters and myself have already said, gambling wins (including competitions) are not taxable by law in this country.

    I know it is not nice for the innocent people like OP's sister, but it is reassuring to know that the benefits agencies are actively investigating "private" ebay sellers.

    Good luck to them, and maybe get rid of some dodgy sellers at the same time.

    Thanks for clarifying that; I knew I had read about problems with mystery shopping and receiving benefits.

    Every county is having a massive clamp down on bogus benefit claimers and those cheating the tax system, and I think that any informers that give a tip off that turns out to be true are getting some sort of payment.

    This in turn is giving people a financial incentive to report anyone who they have the slightest inkling is on the fiddle...

    Emweaver, if your sister is just selling private stuff that she owns, and hasn't bought anything to sell off, then she's fine. I'd be pretty sure that it's a relative or friend that's reported her though, just in case...!
