I too am in Scotland too and our TD has failed after OH lost his job, we have been waiting for our trustees to do paperwork since we received their letter in October confirming they are making us br. Will look out for your posts so am not alone lol:rotfl: am I right in thinking that we do not actually have to go to court? They are coming out to our house with the paperwork he did say in Jan, but have heard nothing, the wait is so stressful!0 -
Rolo, no we don't go to court. We fill in paperwork, send it off and then we get a letter sent to us hopefully saying that we are now bankrupt. I think we also then get a form to fill in with our income and expenditure send it back and then no doubt the appointed trustee will be in touch, but in your case it sounds as though the company who were overseeing your TD are going to continue being your trustee.
I learned from some fantastic people on here that if I wasn't happy with my trstee from my TD then I could end it there and just wait to be appointed one from the AIB so bear that in mind when filling forms in. You don't have to go with the trustee you're with just now. Go through your SOA with a fine tooth comb to ensure they have left you with enough money. Ours had said we had £400 surplus every month but when we did our SOA by ourselves for bankruptcy to ensure we had enough to cover prescriptions, glasses, haircuts etc that our surplus was less than half of that.
If you have any question I have found the people at the AIB's office to be fantastic. They have answered every question I've asked and have been very understanding. So if you want impartial advice as it were give them a little tinkle just to make sure you're not paying out more than is sustainable.

i only have one wee (small) concern as scottish law for b.r is different wouldnt it be good to have a scottish forum on here .

I have a cousin in Scotland who is going through severe hardship with his business collapsing and his landlord going bankrupt in Australia. His estate agent who was managing the house says he cannot get his £2,000 deposit back so I'm very interested in the law in Scotland so I can pass on information (or lead him to this site!). What is AIB?

AIB = Accountant In Bankruptcy They deal with the whole bankruptcy process. Scottish equivalent of the OR arrangement.0

We have CAB, don't know about a law society ... I'll google that for you!
I most certainly am round! 2 babies in under 2 years does you no favours for any other shape asides round
