starting the process now

hi everyone and hope you had a good xmas and new year.
well i am starting the b.r process now .cancelled direct debits going into work tomorrow to change bank account to coop one . then i have to wait for the phone calls ,letters, etc before i can go b.r. (scotland) dont qualify for l.i.l.a. and yes c.c.c.s and n.d.l have recomended b.r

    update well thats some of my payments missed and phone calls started i even recieved 1 at my work didnt answer it . at the moment i havnt spoke to anyone as advised on here .i have recieved some letters askinf me to speak to their own people , i sent letters offering token payments didnt sign them just printed my name at the bottom one creditor even said as i didnt sign it they couldnt do anything about letter please sign this form and return . i have a face to face appointment with local council advisor on tuesday . then going to lawyer about divorce after that.
  • Don't worry Broxiebear1 I know the feeling. Just before christmas I took my head out of the sand and decided that's it. Cancelled DD's and after my bank made a total ****s up of changing my joint account to a single account that was the final straw. £185.00 of bank charges for there error. £38,000 of unsecured debt, I had worked seven day's a week for two years just to treadwater. I know its my fault but after losing my second job I was up the creak without paddle.

    Well telephone calls have started, told em all I had been advised by CCCS and Payplan to go BR.... They still had the cheek to ask for the amounts!!!!!

    Worst part, them calling me at work. Now I'm ready for them. Have told my colleagues that I am going BR due to marraige breakdown and loss of OT and second job. They are all very understanding. My Boss say's she will tell them no personal calls allowed.

    Keep your chin up, my biggest task is raising the fee. So I tell the DCA's to make me bankrupt so I can save on the fee's. That soon puts them in a spin.
  • I ran up debts of about 30k, no fast cars, foreign holidays or expensive goods just crept up on us over 7 years and a lack of work finished me off last Christmas. I thought my head was going to pop until I spoke to the CCCS and they suggested bankruptcy.
    Started the process Feb and all was done by March 31st. The magistrate said 'Bankruptcy is for people in your predicament, Good luck for the future'.
    The weight that has been lifted from us is incredible. Instead of 600 a month going to the banks to not reduce anything I now pay 106 a month for 3 years and thats it. My bankruptcy was lifted after 8 months.
    Its the best thing you can do if you have no paddle, all the best, good luck, your life will soon be yours again, regards Martin.

    i went br 8th dec due to my marriage breakdown and the :mad: of a husband laving me with his debt and with a mortgage shortfall due to him giving up a really well paid job. it was the best thing i could ever do now i dont have to lock the door and keep the curtains shut worrying about people knocking the door.

  • thanks martin as i said seeimg advisor on tuesday as i live in scotland its a bit different than english b.r i dont think we have to go to court just send form to a.i.b i might be wrong will get better advice on tuesday this site has been a godsend for me , i checked bank account old 1 and my pension money has been paid into it a massive £148 for a month thats what im going to lawyer for on tuesday to sign over pension so ex gets half so i will be left with £74 for a month
  • I thought I was going to lose what pension I'd paid into but apparently they don't take it anymore. (In England anyway hope its the same in Scotland). Hope it all goes well. Will follow you to find out. If you're honest and all your paper work is up to date you have nothing to fear. The official receiver I had was sound! All the best.
