  • fengirl - just to confirm the apology letter and explanation about being given a P45 (as the company name had changed) only arrived 3 weeks after the P45 appeared.

    borders_dude - we completely agree about a solicitor but they haven't a penny to rub together (his wages are very small and they have no savings). Also doing research via internet forums are not as bad as you think! It does however depend on the contributors :-) Most importantly, I would NEVER advise a friend to tackle anything this important without talking to an expert.

    comptershack - Thanks for the info about TUPE, will look into. Just to confirm he has continued to work his old hours over the past few weeks as boss has been away. He didn't not want to not turn up at work in case he lost his job/house etc. You have no idea how scared they are about being kicked out of their house!

    Everyone - The bloke is 63 years old and has been a farm hand most of his life. He only came to us after his daughter confided in tears to me over xmas. They are all devastated with what has happened and as we have access to the internet we said we would do some basic research for them i.e. Shelter, ACAS etc. Since we meet with them last night, I decided to place the situation on a couple of internet forums with a view that the answers might provide us with something else to think about. We spent 3 hours chatting, pulling together a chronological timeline and sorting our their paperwork and payslips for them. At least when they go and see a solicitor now, everything is all in order for them.

    If he was "laid off" in October, then he was entitled to 40 years redundancy payments from the "old company" which might be hard to get if it was wound up. If they then say "oh, well we just transferred everything to the new company" then he is covered by TUPE regulations so if the upcoming conversation is about laying him off, he's still entitled to 40 years redundancy but from the new company so they can't get out of it that way.


    Redundancy calculation is normally capped at 20 years.

    "Fred" really needs to seek specialist advice due to the potential complexities involved.

    And there are cutoffs as age approaches 65

    If he is a member of National Union Of Farmers - NUF they will be able to advise. That's what you pay your subs for.

    CAB are good & free, but this is quite specialist, but may provide a free lawyer for initial consultation.
    Local MP can at times be useful depending on who it is - also free.

    They are lucky having such good friends as you.

    Why do you ask?

    Being in receipt of P60s and a P45 rather suggests that everything is legitimate in relation to any tax liability.

    Thats only for the last three years, it only says for previous years that he was paid in cash, kind of implies there may be a further issue for investigation there.

  • I'm confused - the OP does not stated that the OP has been sacked or lost his house - is the worry just about the fact that he may do? Surely best to wait and see if that is actually what they want to speak to him about first?
