URGENT ** advice needed please

ok, so how to start, well we are 3 years into an iva and had some payment problems this year, i had a letter of breach in october , this completely panicked me and i rang them to say we would try to pay 1500 within 6 weeks to get back up to date, the next day i realised this was unrealistic and rang back, after a conversation with a really nice woman she said we could have till march 2010 to get the arrears paid and everything would be fine.

anyway today i get a letter from the iva supervisor saying they have now written to the creditors asking if they want to pursue bankruptcy proceedings, i am in the process of getting the money together as i promised them i would and now it seems its too late.

is there anything i can do ?? and please dont say call them as they dont open again till monday and i am already feeling suicidal over this and am currently sitting here with a lot of tablets.

please help me, i really need some advice ...

Ring the samaritans as an interim measure, and put the tablets away. Someone will be along to help, and it will not be as bad as you are imagining. eta 08457 90 90 90

thankyou for taking the time to reply, i have rang the crisis team as i am registered with our local mental heal;th team but they just said to calm down, its not easy to calm down when the tears wont stop , i cant see any other way out

Well I am no expert, not in the least, but it looks like a communication snafu. I know this is hard but you are going to have to wait until Monday to find out what is going on. If you took the persons name and time you called it should be recorded what was agreed. If it isn't just reiterate what you were told. Its probably not as bad as it seems

In the meantime hang on! Somebody will be along with much better advice than me and in the meantime remember the samaritains or your local crisis team

i do have all those details but the letter seems so final, like there is no other option , there just doesnt seem much point in anything anymore if the last 3 years have been for nothing

woah woah, it's probably a standard letter sent in error. Your IP has a duty to take action when an IVA falls 3months behind but it doesn't mean he HAS to fail it. First he'll make sure things can be rectified and that you're not simply using an iva to hide from your creditors. There are many reasons people might feel as desperate as you right now but debt should not be one of them - sometimes creditors should be ashamed of themselves for the pressure they put on debtors! Worst case scenario now is your iva fails... Would bankruptcy be so bad? I'm asking seriously here! Every financial problem has a financial solution! Who is your IP/IVA Company?

Crickey - hope you are ok. Its horrible when unexpected letters and stuff start to appear - but as Charco says - its quite probably sent in error, they havent got a massive amount of control over what gets printed out - and even less of what gets sent every day. If you have been told that March is ok to pay it by,then they should have record of it - have you a letter for that? Dont panic if not, as the others have said, they should have a recording of the contact, so you should be able to prove it.

PLEASE dont do anythign rash, its really not worth it, theres always a solution, just takes a while to find it sometimes - we are all friendly on here, and though Monday seems eons away, its really not.

i hope you are right as bankruptcy would be the worst thing that could happen as we have 3 cats and a dog and renting with animals is almost impossiible, plus our mortgage is a lot less than any rental property would be. i suffer very bad depression and really dont need this stress. we are with RE10 and up till now they have been fine.

you are so right, monday seems so far away its silly, i dont have a letter confirming march but on the day it was agreed they put a 3 month payment holiday backdated to cover 3 months that were missed (7 in total due to major house problems) so at least that is proof i called . what is so annoying is that we have sold so much stuff over christmas just to raise the funds also hubby has been putting in 70 hour weeks at work and now all our hard work seems pointless.
