asda direct order not showed up

hi can any1 help me

on the 10th dec i place a order with asda direct which didnt turn up i rang them on the 16th as it stated deliverd to be told a manger would ring me back which they did not i rang back up on the 18th to be told it was deliverd to the wrong address and could i go to number 22 and ask for my parcel but theres no 22 my street only gos to number 10 which i live at i spent 1 hour trying to tell them this i have rang up every day they have been opened to keep been told a manger would call me and there nothing they can do but if i want i can ring royal mail and take it up with them can they do this to people is there anything i can do about this

  • Firstly, don't let them fob you off.
    You placed an order, it has not arrived, you therefore expect the goods delivered to you correctly, or a refund. As they have already acknowledged that the item has been mis-delivered, this should be easy. The contract is between you and them, not you and royal mail. Asda contract with Royal Mail, so they should chase any mis-delivery.

    The question though is how you want this resolved.

    With the recent VAT rise, then it may be easier to insist they correct the mistake and ensure the item is sent out to the correct address. If money has already been taken, then you should only pay the original amount.

    The alternative would be to simply ask that the order is cancelled (as allowed under the provisions of the Consumer Protection (Distance Selling) Regulations 2000 (simply DSR for short). To be fully covered, this notification must be made via a 'drable medium' such as email, letter or fax. You must receive any refund within 30 days, starting from the day the cancellation request was given. You can then reorder the item, from elsewhere if needed.

    Either way, I think badger247's idea is also worth a shot.
