Faulty purchase on Ebay

Hi Im desperate for some advice.I purchased a laptop off Ebay last week for my daughters Xmas. We paid £200. However when we received it only works for 10 minutes before switching off. I contacted seller several times and he ignored every email I sent. I purchased a new battery-an additional £50 but still made no difference.I had no option but to start claim with Paypal since thats how i paid. After ONE day of investigating they decided in sellers favour:mad: not sure how the came to that decission so quickly and with NO correspondence from me. I have a video clip of exactly what it does and receipts from new laptop which we had to bu on Xmas Eve for my daughters Xmas. I dont know what to do when seller ignores my emails and Paypal have decided in his favour saying item was as described, which it clearly WAS NOT!! It wasnt listed as spares/repairs which it is:( Please help! As £250 is £250 I cant afford to lose!

I have never heard of paypal deciding for a seller in one day, are you sure you opened the correct claim 'item not as described'?

I emailled Paypal today and they said that because it said this it stated faulty:
15.4 wide "TRUE BRIGHT" screen - when the laptop is turned on the screen staying white and diplays nothing
This info was not highlighted in ad and to be honest with you myself and husband thought this was a feature as it was listed with all the other features.
In no point in the ad did it say spares or repairs.
I asked the condition before buying and was told v good and explained was for present.
The problem has nothing to do with the screen anway its the fact it only goes for 10minutes0 -
Your only other recourse then is via small claims but that cna be difficult, you might want to make a start by colelcting as much info about the seller as oyu can. Request their detils from ebay and keep a screen grab of the auction.
If you want i'll take a look at the auction and see how misleading it looks as you could then decide whether or not to proceed with small claims. I've seen the auction and I believe the seller deliberately hid the fact that there was a problem with the screen as it is listed basically as 'features' as though it is a good thing. The seller is also a trader masquerading as a private seller, so there may be leeway in that, plus their stars are amongst the worst I have seen across the board for a while, add to that a stock photo and I really believe this seller set out to deceive.
I have suggested to the OP that she appeals this strongly with paypal, this is not on.

But as aways it should be Ebay - buyer beware!
However I do agree to reporting the seller should s/he not be acting in good faith, and good luck with PayPal but they can be a nightmare.
I would be tempted with the court option, small claims are easy and quite straight forward to do, but like has already been said you need to collect evidence about the retailer anyway.These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!

Did you pay with your Credit Card? I had a case that happened after the time scale allowed by paypal - and did a claim back off my Credit Card.

From the listing, there is no description of condition nor explains if it works.
What have you done with the laptop.?
What does it do when you boot it up, does it boot to windows, just show the bios option (Press F12) or not even get that far.
I know a man in Leeds who can repair Toshiba laptops, works from home. Prob just a hobby. Repaired one of ours (we both have Toshiba Laptops).

He seems to have a habit of hiding things like that in listings... like this one item number 330385635776 very bottom of the listing

I've just read the description of that item and had to read it twice to spot that. This guy seems very dodgy, the working status of the laptop should be clear in the description. I'm surprised that he only has 2 negative feedback in the last 6 months with selling practices like thatDogs have owners...my cat has slaves...0
