And, of course, just because you have a blue badge, doesn't necessarily mean you need to use a disabled bay every time.0 -

I would urge you to think outside the box for a minute and stop believing the hype spouted by the Supermarkets and their parking agents. They cannot insist on motorists/passengers displaying a blue badge on private land. They have got it wrong (and if Tesco have realised this it will be because of a DDA court case pending I suspect, could be interesting if that is the case).

BY LAW (under the DDA) retailers have to make their premises accessible, making 'reasonable adjustments'. This means that retailers who provide parking facilities HAVE to provide spaces close to the store for all people with disabilities to use. NOT for 'only people with blue badges' to use.

The DDA definition of disability is the only authority on the matter and it does NOT include 'having a blue badge' - simply because those organisations who were involved in making this law never intended it to discriminate so arbitrarily (of course not!). :rotfl:
If you read the link I have given, you'll see that the Act recognises disability at the POINT OF DIAGNOSIS, not from the point when the person has finally got around to going to the GP and among other things, getting a form filled in so they can apply for - and wait for - their blue badge! Are they not allowed to park close to the Supermarket until they have done this, LOL!
Finally, how on earth do you think a visitor from abroad with a disability who has come here on their hols is supposed to 'prove' that disability before parking in a disabled bay at a Supermarket over here?
Short answer, they don't have to!
And the onus is on the stores to realise this fact or they WILL learn from some court cases from people who are discriminated against.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What I really don't understand is why disability groups who should know the legal standing on this are actually supporting the "Battle of the Bays" as they call it.This is just re-inforcing discrimination against other disabled people!!0
