Faulty PC Curry's My Rights Help?

Hi,

Basically I bought a PC back in Feb 09 and its had a few problems that I have just learned to put up with.

The USB slots kick everything out
Monitor goes green
Freezes
Not very clear screen (not sharp at all)

(I have restored to factory settings etc and tried drivers so on so forth all tested)

I called up about the above problems (except monitor - which I went to the store about and they just fobbed me off to the manufacturer!) at the beginning of this month (this computer has hardly been used) and they said its the motherboard and came out and fitted a new one. Fair enough.

Anyway the computer hasn't been used in a few weeks and I have still got all of the above problems, I have had the computer 10 months and I am sick of this. I am not really happy to have a repair again since they have tried this already with no luck I think the machine needs scrapping. I would be happy with vouchers to their store to replace the machine but I just don't know my rights and I am sure to be fobbed off with another call out and still the same problems.

Can anyone help me please

  • You'd be best posting on the consummer rights board, there are probably more knowledgable people over there when it comes to dealing with retailers/manufacturers. But I think that within the first year of purchase it should be the retailer that deals with all that stuff. Also I'd say that with all those faults it probably isn't "fit for purpose", so maybe you should be entitled to a replacement or refund? But I'm really not sure, ask the experts :)

    Get to currys as soon as you can.
    Chances are they have at least a years warranty on it, and really should keep fixing it for you. if your having the same probelm you had, which they said they fixed, bring it to the same place, and mention it again. they should try to fix it again

  • Cheers I have read through but if they said they will only repair where do I stand surely they cannot keep fobbing me off? I am unsure on how to get the result I want, a replacement.

    Curry's will only replace if they can't repair in 28 days. I would take it back whilst you're still in warrenty and demand they sort it out and contact you when they're happy it's been fixed and tested.

    When you go to collect insist on seeing it working in the store and play about with it for a while, if you're not happy and any of the faults can be replicated tell them you want a replacement.

    If you want professional advice then call consumer direct which is the public arm of trading standards, they can advise you of your rights, give you letters to send to curry's and will take up the case on your behalf if it doesnt get resolved satisfactorily.

    Thanks for your response, however I have given them the opportunity to repair. The product is still faulty, so now it is unfit for purpose surely and they are unable to make it fit for purpose as they have unsuccessfully repaired the item?

    Therefore they are obliged to replace the item surely?

    No. They are allowed to repair again, if they wish. Most will try only 4/5 times. Then offer a replacement.

  • But doesn't that come under unfit for purpose and wouldn't it be more costly to fund 4-5 repairs?

    after 9 months you are unlikely to get any court to agree with unfit for purpose.

    Your legal redress is to get the retailer to repair it satisfactorily, if that is not possible they will have to offer you a replacement, but expect a minimum of 3 repair attempts.
