Completed yesterday but we have problems!

Hello,
We completed on our house yesterday and came upon a problem. In the fixtures and fitting list signed by the owner, it was stated that the Washing Machine, Tumble dryer and Dish washer was included in the sale. When we got the keys and got in there all three had been removed. We have contact our sols who are going to chase his solicitors but has anyone else had this happen to them and what was the outcome.
What do we do if he turns around and says he is not going to replace them?

Hopefully their solicitor will make them see reason or retain some of the money until its sorted. Thanks for that, I have never been through the small claims court, is it a long and costly experience ? Is it worth doing in this case?0

Possibly an oversight on the sellers behalf but you do have it in writing so should be ok.
You may well get new ones if the seller has installed their old ones in their new house already.
Make sure you insist that if they are returned or you have to get new, that installation is provided, as had the old ones of been left nothing would have had to be done.

If they were included in the fixtures and fittings list your solicitor provided you, the threat of court should be enough to make them pay up. You have the evidence and they were in the wrong.
The only reason not to go to court would be if you thought they didn't have the funds to compensate you in which case a ruling would be worthless or if they were out of the country.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Ok thanks, we was just worried that if he tried a cash settlement that he would not offer up the full amount to cover the costs of new appliances that are of the same standard. I am starting to think that he would go through the local electric shop and find the cheapest possible prices and give us that cash amount.0

Its possible you can use these to match the ones hes taken (and put in his place). If it comes down to proving he removed them!0
