Returning a camera recieved for christmas

Hi, I got a SOny camera for chritmas that is faulty it was bought from pixmania on the 6th of december but they are saying that they want to send it away for repair as it is out of the 15 day returns period. I think this is out of order as it was a christmas present and wasnt opened until 25th.
I've read that pixmania are a nightmare when things go wrong. any advice?

Unless Pixmania publicised a special arrangement for returned Christmas Presents then it is not out of order, date of purchase determines the return period. You might like to get the buyer to reject it - they have the contract with Pixmania. However its not an easy task to get a replacement.John0

You have zero rights to even a repair unfortunately. The buyer, person who got you the present is entitled to a repair
I wouldn't use pixmania myself with a 10 foot bargepole0 -
Its my girlfriend that bought me it, i was just looking for advice for us both. They have said that they will repair it, but it will take 21days which niether of us are happy with that.
We are thinking of contacting the credit card company that we bought the camera with as after reading on the net there are so many horror stories of dealing with pixmania.0 -
As you didn't try the camera until xmas day you haven't accepted it until then, as this was when it was found to be faulty you can outright reject the goods and request a refund. If they're not playing ball I'm guessing it's over £100 and you can contact your credit card company - playing it this way will take you more than 21 days though to get your money back but does mean you could buy a new camera.0

Keep all contact in your gf's name though as you have zero rights.
Your difficulty is with proving you did not use the goods until Christmas. You may think its a given but no doubt they will argue otherwise.Back by no demand whatsoever.0 -

I agree it's an age old argument in retail but sadly it always boils down to the date printed on the receipt as being the date that the product was used from and the date that the warranty commences.
The OP is better off trying to contact his CC company as the retailers rarely budge on this one.
Just to add that this may well not be the retailers decision either but more a procedure that they follow via Sony themselves, if it goes off for repair it's actually Sony that deal with that. Where I have worked in electrical retailers you would have to follow a set procedure for each individual brand(not saying that's right BTW it's just what had to happen according to store procedure).0 -
They are now saying that they are a French company so our trading laws don't apply. I think it is wrong that they don't advertise they are not a uk company on there site. Best we could get out of them is that ups are gonna collect it then when they recieve it they will send It for repair.
We will never use them again!!0 -
standard fob off from them - if the credit card try the same line tell them to bugg3r off as you have s75 rights via your card no matter where the item was purchased as long as it's more than £1000

French, German doesn't matter you still have the EU directive which is similar to sale of goods act which means the onus is on the seller to get it repaired
