Mistake on advertised contract price

Hi -

I've found what seems to be a mistake in the cost of a contract, on a popular mobile phone site and was wondering where I stand legally on the matter.

The site shows the monthly cost of the contract without any discount, then shows that cashback can be claimed back over a certain amount of months, and then gives the monthly cost after cashback. However, the monthly cost after cashback is clearly wrong (unless there is a mistake in the cashback advertised).

If I take out this contract, would they be bound to give it to me at this price?

    WHat details would you like? If I post the actual deal up it may get taken off..
  • Unlikely. Sounds like a cpw company to me; they often use misleading tactics in their advertising (and follow through afterwards with the same sometimes).

    If you don't post anything - how can anyone judge whether its right or wrong or whether you are wrong in your calculation?

    The deal, if it is a mistake, is not going to be taken away just because you post here (at least not till people are back at work). Why not post the figures without the name of the retailer?

    Most likely there is a cost for the phone!

    If you sign a contract at a rate all parties are tied to the terms of that contract, you are and they are.

    Just make sure that the contract and price is what you expect it to be before you sign and make sure they don't change it after you have a agreed to it.
    I started with nothing and I am proud to say I still have most of it left.

    Unfortunately cpw companies don't honour "mistakes" on their websites. Ordering in legal terms is an offer based on the site's invitation to treat - they don't have to accept.

    The price you will pay is the monthly contract price, the cashback is a gift which you are not guaranteed to receive (see several other threads). The effective monthly cost is just a guide not a contractual obligation.

    If you are not happy with the price do not take it out!
