the 30 day money back guarantee is for those who change their mind and decide they don't want to keep something.
If the hard drive is knackered then the box is not fit for purpose and must be repaired or replaced - the guarantee is not important in this situation - its a faulty item.
Just one thing though - don't under any circumstances tell them you have opened the box and removed the hard drive you should not have done that - as that is their get out clause.
If the box came up with an error when you switched it on then it was faulty when purchased. Politely tell them you require a refund or replacement with a new item - you are not required to accept a repair for an item which was faulty when you bought it. If necessary ask for the manager and tell him you refuse to accept a repair and if they are unwilling to refund or replace you need that in writing to enable you to sek legal advice.

no they don't have tp provide a written statement there and then. You have a sales contract with Argos not the manufacturer. It is their responsibility to correct this for you. They will probably insist the box has to be returned to the manufacturer but that is thir responsibility. You should be firm and polite and tell them that because it never worked you wish to reject the item and obtain a refund or a new replacement there and then rather than wait for a repair. You did not buy a repaired item you intended to buy a new working box.
If you lose your rag they will be difficult so just stay polite and tell them what you require - full refund or replacement there and then. But do not leave the faulty box with them if they refuse to do this unless you get a receipt stating this - you could write the statement yourself, take it along and ask them to sign and stamp it - trouble is then you will have to pay for legal advice and wait until the claim is resolved to get all your money back.
As long as you have told the truth and it was faulty out of the box you should be ok - just stay calm in the store and ask to speak to the most senior person on site - if no joy ask for details of customer service and make notes of times and names of people you speak to in store and on phone.John0 -

While its technically correct i dont think its a good idea to mention this
Less they know less holes they have to hide into. Facts only, which really are like this
1) Paid for box at the till
2) Got the receipt
3) Waited for item to be found in warehouse
4) Pick it up, go home
5) Connect - nasty sounds + E68 error.
The fact that i know what causes fault is irrelevant inthis case. Fault was "out of the box".0 -

I had a similar fault with the HD not working on my X Box which I bought from HMV.
There was nothing wrong with the HD but a little plastic lug on the box which retains the HD was broken and I needed a new box. Apparently this is a common fault?
Your contract is with Argos and they are responsible. Like most retailers, HMV tried to fob me off and told me to contact m$. I am sorry for the long delay.
I have got the new disk from argos. Also discovered some disturbing facts about them.
Went in, spoke directly to shift manager, he says "no problem" we can replace the disk only, no need for the rest of the console (which works fine btw). I say "cool, lets do that". And so he did. He took an Elite Xbox360, opened the sealed box, took off a hard drive module, handed it to me, took my broken one and put it in new xbox he just opened....AND PLACED IT BACK ONTO THE SHELF WITH THE REST OF NEW XBOXES. Simple as, disturbing as hell...
In an unlikely event of the stack being ALL defective (unlikely, i got my new drive from the stack) someone is going to get my old broken hard drive. How uncool is that ? Should bother to report it higher up the argos foodchain ?
Ah, i got a receipt and a new warranty date for replaced disk as well, so it all looks legit practice, but still a bit unsettling...0 -
