Tesco wont refund

  • You should be able to get a replacement, not sure about a refund, we had a similar issue last year with a singstar game for the PS3, when we tried it it froze on one of the songs continually so took it back, they weren't keen at first even to replace it but we stood our ground and got a replacement that worked fine.

    Rubbish.
They do NOT have to refund.

    A replacment is legally acceptable.
No, this is rubbish. The fault has been discovered within a reasonable time and therefore a full refund IS an appropriate remedy under the SOGA.
  • @ Enfiedlian Be nice to other moneysavers!

@ Parker156 If you still have an unopened copy I would return this to Tesco with the Tesco receipt and claim your refund. You probably won't know having mixed them up after receiving them which one was originally bought from Tesco now anyway. I know in my house this has happened twice with a DVD and a game, one each will be returned to whichever store is closest, I've no idea which one was from which relative, and it doesn't matter, they are identical.

If you have opened both copies (learn from this experience for next time) then you will just have to pressure Tesco into giving you the refund, or you could try and get the other receipt and try refunding with them. They might be more helpful and aware of your rights.

Either way it will probably involve a bit of a fight, but you will get there in the end. Sending letters to head office quoting the SOGA always helps move things on I find.

If they still won't budge check your house insurance to see if they offer legal advice for this issue.

If not join which legal service with a free trial if they have one on at the time and get advice from them, they do cover this area.

    Hope this helps.

    Do you have the receipt?

    Is it actually genuinely faulty?

dmg24, I noticed you THANKED this person for this response. Is there some kind of pally pally childish game going on on this forum to help the little cliques get lots of thank yous? It would appear so because this rather unhelpful and frankly useless response is just not worthy of a thank you. Astonishing. :p

Why not thank that post? It asked two pertinent questions. Long standing members of MSE are really not at all concerned with the thanks button.

Due to its, stupid (imho), position the Thanks button often gets hit instead of the intended Quote button alongside it.

In my experience Tescos customer staff - and the store manager - refuse to acknowledge the existence of the SOGA.

I had to return something which broke the first time I used it, but was beyond their returns policy date. After complaining three times, citing appropriate sections of the SOGA, they eventually refunded me 'as a sign of goodwill' but in their letter maintained that they had no statutory duty to do so.

The Following 4 Users Say Thank You to ses6jwg For This Useful Post: Show me >> dmg24 (26-12-2009), pendulum (Yesterday), Pink_fluff (26-12-2009), sarahg1969 (Yesterday)

So you 4 lovely people. :T Why did you thank ses6jwg for a snide remark? I think this behaviour perfectly demonstrates the level of nerd that spends most of their time pouncing on people to do no more than vent their bitterness at people like me. I feel sorry for you. In fact I pity you. Society is getting very opinionated and selfish. I wonder if I should press that little red triangle with an exclamation mark in it?
:naughty::naughty::naughty:Who are you then - self appointed thanks police. dmg - you'd best watch it, one more strike and you're reported.

You are entitled to take it back for replacement, getting a refund will be difficult.
You are entitled to take back a faulty item and get a refund.

(Oh, and the allegations of piracy are irrelevant and slanderous!)

Assuming all that the OP has said is correct, Prowla is 100% correct.

Cannot believe some of the carp that is spouted on here....
