Buildings & Contents Insurance Refund

I cancelled my buildings and contents insurance about 10 weeks ago. The insurance had oiginally been taken out via a broker.

When I originally cancelled this policy, the broker said that the refund (about £700) would be remitted in about 4-5 weeks.

I appreciate that this process would entail the insurers forwarding the cheque to the broker, who would in turn send this to me. I also understand that this process can at times be slow but a friend of mine had to wait about 6 months to get their money.

I am sick of hearing the same reply from the broker, namely that the insurers have this in hand.

With this in mind, I wanted to know who is responsible for this refund from a legal perspective ie the broker or the insurance company itself.

  • From how I understand it the contract is between you and the broker so they are the people you turn to for help when it is needed. So in my opinion they should be refunding you the money then its their problem (which should affect you) to get their money back from the insurance company. After all they wont lose out as they keep all of it plus a little extra from the cancellation fee you may of had to lose from that refund.

    technically the broker is the one you made the contract with but they are only acting as underwriters for the insurance, i suspect if you were to read the fine print under cancellation it would set out what is expected from the broker
    Everyones opinion is the most important.....no wonder nothing is ever agreed on.

    I have looked through all the docs in my possession and there is no reference to cancellation specifically regarding whether the broker is liable (so to speak) for refunding.

    I did want to send a letter to whichever is responsible offering 7 days for payment to be remitted but obviously I need to be clear on who that is.

    So ask the broker to point you to the exact paragraph where the wording is.

    If they can't do this or dilly dally then go through moneyclaim online and start proceedings in the small claims court.
    That should get their attention one way or the other.
