    In this situation I think that it would be in your best interest to pay PayPal what you owe. The situation will only get worse and could end up affecting your credit rating.

    For the future remember to send valuable items via special delivery only.

    Like I said before, I couldn't sleep knowing I owed that money. IMO you'e no better than a common thief. You owe them so pay them!

    Did you offer the buyer the option of having it sent recorded, or did you just say you'd send it normal post? If they chose normal delivery, then they've taken the risk of it going missing.

    Have you contacted the post office and reported a package lost? You can't get compensation but you might get some info from them.

    Kay - it's irrelevant what method of postage the buyer asks for, nor is it the buyers problem that the phone has gone missing.

    Sellers are responsible for items that go missing in the post. It is up to the seller to send the parcel using a method that provides adequate compensation should the item go missing. In this case, I would have sent the phone by Special Delivery, so I could refund the buyer and claim the full £100 back in the event of it being lost.

    The paypal terms and conditions are quite clear in that to prevent a chargeback where goods are not received an online trackable method of posting must be used. (I would link to paypal site here but am having major PC problems and only get a few mins on line each day).

    The trackable method would have prevented a chargeback if it showed delivery, or if you had used special delivery insured for the correct amount would have enabled you to refund the buyer and reclaim your losses from the Royal mail if delivery wasn't confirmed.

    A recent article in the Mail on Sunday financial section suggested that paypal have been in trouble before now for sending in heavy debt collectors to collect payments, so yes you do need to be worried. However, despite the 'heavy' tag, they do still need to comply with all the usual requirement sof the debt agencies so you may be able to slow down, but NOT stop the process by asking for proof that you have received all the proper notifications.

    As has been suggested talk to the people on the debt board, they should be able to tell you what the debt collectors need to do to comply with the regs.

    At the end of the day you've been scammed as you have no proof of delivery
    you will have to pay the buyer back the refund , it happened to me, hope in future you will make sure you send by recorded delivery or speical delivery and keep all reciepts . and put it down to expeirence
